The question of minorities in Bharteeya society and politics is one of the most complex issues which needs serious consideration and analysis of our history.

Bharteeya society is a wonderful mosaic of various sects, creeds, languages and so on. But amongst all, ‘religion’ plays an important role when it comes to political manoeuvre and social undercurrents. National integrity is also dependent on religious communities and cordial relations between them. Constant strife between majority-minority communities ensures national disintegration. We have had many in our history; one of them was in 1947.

Without considering the parameter of minority, we can’t proceed further. Constitution of Bharat does not define the term ‘minority’. But we can see that ‘minority’ depends on the numerical strength of a particular community vis-à-vis total population. But to what extent? When it ceases to be a minority?

But unfortunately we still haven’t defined ‘minority’ and political clan is therefore free to use it as they wish to serve their petty purposes.

Blaming political brethren alone won’t help. The social thinkers, intelligentia, mediapersons and social workers also need to actively work for it. And therefore our viewpoint towards non-Indic religions, nationality and hindutva matters.

Nationality – State is said to come into existence when it contains four essential ingredients viz. specific territory, people, government and sovereignty. But ‘nation’ is a sentimental and psychological concept. When people believe in one nationhood, a nation is said to be existing. Then there may not be a specific territory.

As the example of Israel goes, Jews had a strong feeling of oneness and dreamt of a nation for decades together. They had no Israel or their own country and were scattered all over the world. But they made it a point to converge at one place annually. Elders, youth, women continued to reiterate the remembrance of Israel on that day of congregation. They had a meal at the end of that function, called ‘Passover Meal’. After this meal, they resolved each year, “next meal over there”, means in Israel. World laughed at them. People mocked these Jews saying how can they dare to resolve when they are such a small community disseminated through the continents? But their determination and unity proved the mocking people wrong. And today we can see the mighty Israel. This took several generations. But the flow of nationalism continued and taken ahead by one generation to the next. Such is the uniqueness of nationalism.

Now when it comes to our country, which is such a binding force? Having multifarious society, hundreds of languages, thousands of dialects, and diversity of cuisine, rituals, and costumes makes it difficult to bind this populace in a single thread. Though it is a difficult task it’s not unachievable. The thread is inevitably the Hindutva. The 52 shaktipeeths from kamakhya in Assam to all other parts of the country, 4 Ashramas established by AadiShankaracharya in four corners of Bharat, the shlok

गंगे च यमुने चैव गोदावरि सरस्वती |

नर्मदे सिंधु कावेरी जलेस्मिन् सन्निधिं कुरु ||

People used to chant this shlok before they began to bathe. It simply regards Bharat as one country, one nation. Or the shlok which describes places of pilgrimage situated at various places of this nation, and a Hindu always strives to visit these places to pay homage.

अयोध्या मथुरा माया काशी कांची अवंतिका,

पुरी द्वारावती चैव सप्तैते मोक्षदायकाः |

Therefore prior to arrival of British we were one Nation.

Gandhiji’s thought on nationhood – Gandhiji, while giving a thought to this issue says, “The English have taught us that we were not one nation before and that it will require centuries before we become one nation. This is without foundation. We were one nation before they came to India. One thought inspired us. Our mode of life was the same. It was because we were one nation that they were able to establish one kingdom. Subsequently they divided us.”

“I do not wish to suggest that because we were one nation we had no differences, but it is submitted that our leading men travelled throughout India either on foot or in bullock-carts. They learned one another’s languages and there was no aloofness between them. What do you think could have been the intention of those farseeing ancestors of ours who established Setubandha (Rameshwar) in the South, Jagannath in the East and Hardwar in the North as places of pilgrimage? You will admit that they were no fools. They knew that worship of God could have been performed just as well at home. They taught us that those whose hearts were aglow with righteousness had the Ganges in their own homes. But they saw that India was one undivided land so made by nature. They, therefore, argued that it must be one nation. Arguing thus, they established holy places in various parts of India, and fired the people with an idea of nationality in a manner unknown in other parts of the world. And we Indians are one as no two Englishmen are.” [1] Therefore, it becomes clear what the Gandhiji is referring to as a base of nationality and nationalism. He might not have taken word ‘Hindu’ openly in this regard due to political or other constraints on him. But surely Setubandha (Rameshwar), Jagannath, Hardwa, Ganges and the ancestors he is referring to the common thing as Hindu. Therefore people believing in Hindutva can make a strong nation of this country.

Indian politics has seen religion as a very dangerous yet instrumental factor for political parties and leaders. The parties which claim to subscribe to Gandhi ideology or claim to believe in Gandhian thoughts, make a poor show when it comes to assertion of Hindutva. On the other hand political parties claiming Hindutva affiliation consider petty caste and religion arithmetic for electoral victories. This creates utter confusion in the minds of common people but at the same time it destroys the very fundamental of secularism. It harms Hindu population more, being a highest vote share, easily divisible on caste lines and lacking single leadership.

Shahbano case: attack on secularism – The judiciary is considered supreme in our country when it comes to deciding of a case, law-point, implication of a statute or Constitution and so on. Its decision attains finality, if decided by the Supreme Court. The Shahbano Case[2] happened to be an example of ugly politics founded on religion and appeasement of a particular community by a political party. The Supreme Court gave its verdict[3] in this case favoring Muslim woman’s right to ask for maintenance after talaq (divorce) from her husband. Against this verdict, Muslim clerics and some extremists men started a campaign which spread with help of political parties. In fact the Government should have acted in a stern manner to deal with it and suppress the opposition to SC verdict to maintain the sanctity of law and supremacy of the system. But instead of doing this, it passed a law in the Parliament on the basis of its majority. That Act was named as ‘Muslim Women (Protection of Rights on Divorce) Act, 1986. This law was intended to serve the demands of the extremists. It simply nullified the SC verdict. Thus it was a shock for secular credentials of a Government.

Divisive policies of Government – Government started various policies and programmes to uplift the downtrodden. But it did not perceive poor as simply a poor person, rather it identified him by his religion. Separate Ministry at Union as well as State level came into existence viz. Minority Development Ministry. A Minister from Minority community heads this Ministry and disburses State funds for welfare (?) of minority community. Haj subsidy is one of such issues where the Government should not spend its money received from common man. But SC has also held its validity. Poor Muslims may be assisted to visit Mecca. And that is continued. Now recently CM of Maharashtra Prithviraj Chavan inaugurated a new Haj House at Ganjipeth, Nagpur. This Haj House has come up on 19,000 sq.ft. It was completed by spending ` 15.5 crore. It has 40 rooms with 10-person each capacity. State Government worked very hard and efficiently in this regard and accomplished the promise! State Government is very poor according its own statements time to time. It has ‘no fund for Sainik Schools’ , ‘no money to buy power for cities like Thane and Pune’ , The State Government cannot pay the due increase in payment of Aadarsh shikshaks (ideal teachers) chosen by itself. Reason? No funds! And to add insult to injury, at the inauguration of this newly built Haj House, CM of Maharashtra Prithviraj Chavan has demanded ` 500 crore from Centre towards various developmental activities for ‘minority communities’ in 10 districts of the state. Is it not a mockery of secularism? If it is not minority appeasement, then what else it could be?

Prime Minister Manmohan Singh also meanwhile stated that people from minority community have first and foremost right over the resources of this country. This was clearly a move to woo those voters other than majority community.

Does poverty have a religion? Meanwhile, Bombay High Court was hearing a case challenging the religion-based scholarship and freeship of the Government. Consider a situation, where two friends go together to a school. They are next door neighbours of each other. They sit on the same bench in their class at school. Their parents earn almost equal amount of money by doing similar work. They live in a slum. The only difference is, they profess different religions. When their school teacher will announce the religion-based scholarship, the one, professing religion of minority will become its beneficiary. The other, hailing from majority community will be simply ineligible for this scholarship. Why? What the teacher is going to answer that poor little child, when he asks, why am not getting the scholarship when my next door neighbour and my classmate, sharing the same bench and lunch is getting it? You literally will have no answer than saying that, “you will not get it because you are a Hindu!”. His only mistake was to take birth as a Hindu. And still we call this as ‘secularism’! You are sowing seeds of discrimination and hatred. It is hazardous for national integration.

Challenges before national integration – Thus from above narration of various events, it becomes clear that the Government as well as leaders in political and social life are pretending to be secular and under the guise of being secular they are spreading hatred.

In addition to the deeds of politicians, we have Islamic terrorism from across the border and finding its base on our soil as well. This fundamentalism and extremism can only be curbed by unity of people. No armed force will fully be able to wipe out the menace which has found its roots in some villages too. Love Jihad is a new dimension to the Islamic extremism. It will be dealt by alert youth which actively takes part in social life other than cricket, Bollywood and parties.

Christian missionaries and conversion problem is not new. We had great atrocities by St. Francis Xavier, who brutally massacred Hindus in Goa and Malabar. They pretend to work for the poor and downtrodden with ‘sacred heart’, but here they find their prey which results into scapegoat to increase the number of believers. Once people change their faith to Christianity, their language, cuisine, costumes change. Such things should not come in the way of worshipping God. But unfortunately it is so. And by this, the bond with the soil is sapped. They feel Jerusalem nearer to them. This conversion problem was considered by Gandhiji in his writings. He has categorically remarked that "I am sorry to have to record my opinion that it (Christian missionary work) has been disastrous. It pains me to have to say that the Christian missionaries as a body, with honourable exceptions, have actively supported a system which has impoverished, enervated and demoralised a people considered to be among the gentlest and the most civilized on earth.". When a nurse asked him, "would you prevent missionaries coming to India in order to baptize? Gandhiji replied, "If I had power and could legislate, I should certainly stop all proselytizing. It is the cause of much avoidable conflict between classes and unnecessary heartburning among the missionaries".

Even Dr. Babasaheb Ambedkar had lucrative offers from Christianity and Islam when he was on the verge of conversion with mass of downtrodden people. He simply denied it and thought of Sikhism, Jainism and Buddhism for choice. Simply because these were the religions of this soil. Basic tenets of these religions are the same. He very well new the implications of converting to a foreign religion. He did not want to become a person detrimental to the national integrity. Ultimately he chose Buddhism for various reasons.

Hindutva and national integration – Whenever a region becomes Hindu minority region, it begins claiming to get separated from the rest of Bharat. Is it not because Bharat is a Hindu nation? Whatever may be the reason, history proves that for the integration of our nation, Hindutva is essential thing that not only binds all together, but also attaches them to this soil. Therefore Hindutva should be the base of national integration. It is the mainstream of our nation. No doubt countless streams and brooks of various religions and sects will come and merge in it, but the flow will be invariably Hindutva. Thus people should be assimilated in the mainstream, as Hindu population of this country is doing from centuries.

• We should clearly make a distinction between religion and dharma. These two concepts are different and cannot be used as synonyms. Scores of Supreme Court decisions have held that Hindutva is a way of life and cannot be limited in a sense of religion known to other parts of the world. It is a Dharma not religion. Dharma and religion are two different words. They are not interchangeable and one cannot be substituted for the other. The sentence in a Commentary on Constitution of India by Durga Das Basu makes it very clear; it says, ‘while Religion includes some and excludes all others, Dharma includes all and excludes none’. Therefore when we say Hindu Nation or Hindutva or mainstream as Hindu, we wish this widest concept of humanity essential to lead the world on path of progress, eco-friendly development, universal brotherhood and ultimate peace.

• Impartial Judiciary – the role of Judiciary as an impartial body to protect the rights of citizens is very essential. It is the custodian of Constitution. It also has given the right to declare any law passed by the legislature as unconstitutional or ultra-vires , if that law in its opinion violates the Constitutional provisions. But to visualize this unconstitutionality and declaring it to be so i.e. to strike down such laws, the judiciary not only needs to be impartial but to be fearless as well.

• Strong leadership – Not only political leadership, but also social leadership and NGOs need to be strong in matters of secularism and things detrimental to national integration. For petty benefits these leaders should not compromise the national interest. Its time they recognize their responsibility and duty towards social harmony and interfaith unity.

• Choice of right leadership – Indian electorate votes on lines of caste, money, allurement, regional lines but seldom on the issue of development. Recently Shri. K. S. Sudershan, former Chief of RSS and and eminent Muslim cleric Maulana Kalbe Sadiq have issued a joint appeal to the electorate not to vote on religious lines. Instead they want voters to send honest representatives to assemblies and Parliament, regardless of their community of origin. This a welcome step.

• Muslim intelligentia – The Muslim clerics and people from Islamic intelligentia should take upon the task to fight the extremism from within. They need to appear as bold enough to disown violence and terrorism in the name of religion. They need to tell their Islamic brethren, especially the youth, the meaning of Jihad and such other issues like cow protection. It can be done by harmonious construction of the Quran and other Islamic scriptures. They need to consider their responsibility in this regard and try to maintain the peaceful approach of Islam. That is the need of the hour.

निवडणुकांचा मोसम आला...पडघम वाजू लागले...काही दिवसांनी मतदानाचा पाउस पडेल...हिरवे गवत उगवेल नवनिर्वाचित लोकप्रतिनिधींचे आणि लुसलुशीत कुरणे तयार होतील...पुन्हा नव्याने चरायला...

मला माझ्या रुपारेल कॉलेजची खूप आठवण होते.. विशेषतः पावसाळ्यातल्या त्या मस्त कँपसची..

पावसाळा आला की तिथे पहिल्या आठवड्यात नुसते डराँव डराँव चालू असायचे बेडकांचे..! इथून तिथे उड्या घेत असत हे बेडूक. आजचे उमेदवार आणि राजकीय नेते हे असेच नव्हेत काय? या पक्षातून त्या पक्षात, त्या पक्षातून अजून पलिकडे...

कसलाच धरबंध नाही...कोणी तिकीट मिळाले नाही म्हणून, कोणी कोणाला तिकीट दिले म्हणून, कोणी हव्या त्या मतदारसंघाचे तिकीट मिळाले नाही म्हणून, कोणी नातेवाईकाला उमेदवारी दिली नाही म्हणून...

मग काहींनी तर पक्षाच्याच कार्यालयावर हल्ले केले. खळ्ळ-खट्टॅक, फळ्ळ-फट्टॅक अन् राडा सुरु झाला. नासधूस, धक्काबुक्की, शिवीगाळ, तोडफोड अशा शब्दांना उठाव आला. समजूत काढण्याचे प्रयत्न सुरु झाले. चूक या निराश-हताश इच्छुकांचीच आहे. आपण कोणत्या स्वार्थी जमातीची तळी उचलून भांडत आहोत हे बिचाऱ्यांना आधीच समजायला हवे होते. कोणासाठी आपण पोलिस केसेस अंगावर घेत आहोत, कोणासाठी वडापाव खाऊन उन्हातान्हात कंठशोष करून घोषणाबाजी करत आहोत, कोणासाठी बायकामुलांकडे दुर्लक्ष करत आहोत हे कळायला हवे होते. तेव्हा बाईकवर झेंडे लावून घेतले, नंबरप्लेट्स बदलून घेतल्या, रॅल्या काढल्या.. आणि आता जेव्हा उमेदवारी कोणाला कोणत्या निकषावर दिली गेली, त्यामागचा ‘अर्थ’ कळल्यावर भ्रमनिरास झाला.

पक्षनिष्ठा हा शब्द तर कालबाह्यच झालाय जणू. पद-प्रतिष्ठा-पैसा हे मिळायला हवे, मग ते कोणत्याही पक्षातून का असेना, हा विचार बळावत चाललेला दिसून येतो. आयाराम-गयाराम ने ग्रासलेली राजनीती सर्वांचेच नुकसान करणारी आहे. ‘उमेदवारी नाही मिळाली तरी मी पक्षाचे काम करत राहीन कारण त्या विचारसरणीवर माझी श्रद्धा आहे. त्यासाठी मी घाम गाळला आहे.’ हा विचार होत नाही. पक्ष कोणाला तरी एकालाच तिकीट/उमेदवारी देऊ शकतो हेही तितकेच खरे. परंतु या कार्यकर्त्यांचेही बरोबर आहे, जर पैसे घेऊन तिकीट दिले जात असेल, नातेवाईकांना उमेदवारी दिली जात असेल तर त्यांनी तरी गप्प का बसावे?

तेव्हा बेडूकरावांचे गर्जन सुरु झाले आहे. टपाटप उड्या चालू झाल्यात. कुणी ‘आनंद’ घ्या कुणी मुकुंद घ्या अशी परिस्थिती आहे. कोणाचा कोणाला पायपोस नाही. नेत्यांनाही हे कळण्याची आवश्यकता आहे की आपण ज्याला राबवून घेतला आणि इतरांची डोकी फोडायला, राडा करायला वापरला तोच आपल्यावर उलटू शकतो. ‘करावे तसे भरावे’ या न्यायाने आपण जे बी लावले त्याची येणारी ही फळे आहेत. ती चाखावीच लागणार.

Satanic Forces!

Human Rights must be guaranteed in a democracy in order to be a meaningful democracy. Can world’s largest democracy protect the rights of it's citizens by turning blind eye to the present situation and future challenges?

The immediate concern is the sub-judice case by Google and Facebook before Delhi high Court. Actually it is an appeal against lower Court’s order.

It involves showing of objectionable content on it's webpages. This content is created by perverse users registered on these sites. Some viewers complained against it and Court threatened these sites to shut them down in Bharat. Now against that order of lower Court, Google and Facebook have appealed to the Delhi HC.

Second such incident is the happenings at the Jaipur Literature Festival (JLF) in Rajasthan. The organizers had invited Salman Rushdie to participate in the JLF. He had agreed to come, and announcement to that effect was made. But some forces started opposing his arrival and protested largely. It was all due to meager chunk of people, who ignited all the community. Government suggested Rushdie to avoid coming to Bharat. Threat to his life was the reason. Who threatened his life? Who issued fatwas? Is our Government so weak that it cannot go ahead to protect a person for some days? Is it really so feeble to bow against some extremist blockheads?

4 authors went ahead and read out passages from ‘Satanic Verses’. Now the Rajasthan Govt is behind them. They left Jaipur abruptly in fear of arrests. So is the state of ‘freedom of speech and expression’.

Infact the Rule of Law in Bharat is sufficient to deal with both the situations. The users who posted and published objectionable content can be very well booked and punished under the Indian Penal Code and Information Technology Act, 2000. Such is the case with the extremists who say ‘we won’t allow such and such person to enter Bharat’. Are they Govt.? or Constitutional sanctioning authority? Will Govt depend upon their approval? Does it not show absence of sovereignty in the Govt? Thus it is high time now, Govt should deal in strong and stern manner with these non-State actors. Who undermine the sovereignty of Govt. Political will is needed. One cannot expect the ‘vote-hungry crowd’ to discharge the duties properly. ‘Vote-bank greed’ won’t allow you to act rationally.

Like Salman Rushdie, Taslima Nasreen – Bangladeshi writer in exile – faces the same fate. Threats, endless feeling of insecurity, constant danger, frenzied mobs and satanic forces! What is their fault? To speak out against violation of Human Rights? They need to be protected and to be given the freedom to make people aware about the religious fanaticism and ideological extremism.

One can argue very well that the case of M F Hussain was similar to Mr. Rushdie or Shrimati Taslima Nasreen. Why then M F Hussain be condemned and Rushdie and Nasreen be protected and given free hand? This is very attractive argument to defend the case of Hussain. Also it seems valid prima-facie. But one needs to consider some basic difference between the two cases and then arrive at a conclusion.

M F Hussain was himself a Muslim. And he painted Hindu Gods and Goddesses in such a manner which hurt Hindu sentiments. He never painted any other religious figures than Hindu, in derogatory manner – to which some perverts regarded as an ‘art’. But did his ‘art’ prevent him from depicting other religious Gods but Hindu deities? Hence Hussain can be said to be a part of the fashionable cult whose only agenda seems to attack Hindu beliefs in Bharat. Such is not the case with Salman Rushdie and shrimati Taslima Nasreen. They themselves are born in Muslim families and they talk about the dangerous trends in Islam. They wish to eradicate the things detrimental to humanity at large. They need to be given the status of ‘reformationists’. Every religion except Islam has undergone the process of reformation at some or the other point of time. Many have undergone such process more than once. But Islam is an exception.

The thing which opposes reformation ceases to exist. Animals, plants, birds, insects, structures, machines, theories need evolution and reformation to maintain it's existence. Be it a lively or lifeless thing – natural or manmade – change and adaptation to changing environment is a must. How a religion can be exception to this eternal rule?

Thus Islam needs to come out of stagnation and accept new things. Salman Rushdie and shrimati Taslima Nasreen are the voices of billions of oppressed women and compelled children born in Islam. The voice of justified silent sufferers. It should not be suppressed. Humanity ought to give protection to such fearless and courageous ‘reformationists’ and contribute to their relentless efforts for the Herculean task.

Protecting Minority Rights in Bharat.

This is a summary on the topic of the above Title, presented by me in recent visit to European Countries. -

असतो मा सद्गमय,

तमसो मा ज्योतिर्गमय,

मृत्योर्मा अमृतं गमय,

I belong to the ancient land of seers and sages who devoted their lives in quest of peace and emancipation of soul. Gautam Buddha, as we all know, left his palace in search of peace. Today, the world is facing serious problems of Human Rights violations and atrocities on vulnerable sections. Terrorism, religious fundamentalism and ideological extremism are some of the most dreadful challenges before human race. We, as one of the oldest civilizations in the world – Hindu Civilization or more popularly known as Indus valley civilization, have lot to share with the world to make it a better and more beautiful place.

India i.e. Bharat has now a total population of about 120 crores (more than 1 billion). Owing to different languages, sects, religions (worship modes), cultures, regional varieties of costumes and cuisines, philosophies, we have a great mosaic of social patterns. All these aspects make every individual hail from minority community. But as a whole, Indian populace is one united nation owing to various factors providing a base to establish unity.

Minorities based on religion: India is essentially a Hindu Nation. Not by religion but by culture and tradition. Infact this culture has enabled India to assimilate the invaders, refugees, intruders into the mainstream and grow with them. The prayer from Vedas (oldest known literature to mankind) says, “आ नो भद्राः क्रतवो यन्तु विश्वतः|” (aa no bhadrah kratavo yantu vishvataha) meaning “let noble thoughts come to us from all directions). Today we have Muslims, Christians, Parsis, Jews as religious minorities. To protect their rights and bring them to mainstream, Government of India has a separate ministry called ‘Ministry of Minority Affairs’[1]. Its budgetary allocation was ` 2500 crores (25,000 millions). It provides for scholarships, freeships and other beneficial policies for persons from religious minorities. India had 2 Muslim Presidents as of yet. Today also Vice President is a Muslim viz. Hameed Ansari.

The Constitution of India is supreme law of the land and is a custodian of fundamental rights. It specifically confers upon its citizens the Rights to Freedom of Religion (Articles 25 to 28). Stretching this Freedom too far, some groups try to convert people from one religion to their own. This is done by force, allurement or under the garb of service. Such mass conversion destroys the indigenous culture of that group. Mahatma Gandhiji had said, “If I had the power and could legislate, I should stop all proselytizing. In Hindu households the advent of a missionary has meant the disruption of the family coming in the wake of change of dress, manners, language, food and drink.” (November 5, 1935). In protection of minority rights in North-East India, I urge you all to experience the indigenous culture there and visualize the mass conversion resulting into not only the demographic change but also destroying cultural identities.

So is the case with tribals in India. Tribal population is 8.43 crore i.e. 8.2% of total population[2]. Tribals are nature worshippers. They consider God in trees, snakes, cows, birds and rivers. Some groups are trying to destroy their culture and convert them to their own fold. Constitution of India considers these tribals as Scheduled Tribes. Special provisions are made to protect their culture. Many NGOs like Vanvasi Kalyan Ashram are working for them.

Parsis hail originally from Iran. They arrived on western coast of India. They and people on the coast were unable to communicate with each other, as each other’s languages were not known to them. The King there gave a glass filled with milk completely upto the brim. This was to tell the Parsis that there is remains no space to live. But the Parsis put a spoonful of sugar into it and suggested that we will live here amiably and assimilate with society as sugar in the milk. Today, Parsis are only 69,000. They are really a minority. But they have shown merit and achievement in many fields. They never subjected to any human rights violation ever. Tatas and Godrej are one of the biggest industrialists in the country. Only 2 persons were conferred title of Field Marshal by independent India and 1 of them is Parsi viz. Sam Manekshaw.

Jews lived a very safe life in India. When they were facing atrocities in various parts of the world, in India their community enjoyed freedom and liberty. Today also, being a minority they never feel subjected to any discrimination.

Regional Minorities: India is a Union of States. Every State has its own State Government but all people are governed by the Constitution of India. The exception is the state of Jammu and Kashmir. This State has its own Constitution and special status. The people known as Kashmiri Pundits were forced to leave the valley. This exodus from the valley resulted in seven lakh Kashmiri Pundits to stay away from their homeland and to live elsewhere in the country as refugees.[3] Their condition is pathetic. I take this opportunity to bring to light the real state of the affair.

The Jammu and Kashmir has always been a part of India. Lakhs of Hindu pilgrims visit the shrines of Amarnath and Vaishnodevi every year.

Indian Army builds bridges, roads and dams with its mechanical and engineering divisions. But it is wrongly blamed for Human Rights violations in the valley. The terrorism, especially cross border terrorism, is the real cause of Army’s presence there. Now it’s a debatable question whether terrorists have human rights, but apart this, Kashmir remains attraction for international policy makers. Recently, the Global Human Rights Defence (GHRD) in partnership with the Human Rights Focus Pakistan (HRFP) held a press conference in Muzaffarabad and brought in light the key issues in Pakistan Administered Kahsmir (PAK) as[4]:

a. Unavailability of the right of minorities to vote in elections.

b. Lack of political representation of minorities in the national Assembly.

c. Lack of citizenship for minorities.

d. Lack of employment opportunities for minorities.

Three approaches are there to solve the Kashmir issue:

1. Jammu & Kashmir belongs to India given its history and accession instrument signed by the then King of Jammu & Kashmir.

2. Jammu & Kashmir belongs to Pakistan given its Islamic majority population.

3. Jammu & Kashmir is a separate state i.e. Azaad Kashmir – i.e. nothing to do with either India or Pakistan.

To decide which among the three will be the correct answer to the problem, some suggest plebiscite. And it is very fair approach. Let the people living there decide about their choice. But the demand for plebiscite could have been the right approach some 60 years ago i.e. in 1947, when the population was mainly the original residents living for generations. Now seven lakh (7,00,000) were driven out in this six dreadful decades Will the plebiscite be justifiable now? Bringing back all these exiles, rehabilitating them and then performing plebiscite would be the right course to solve the problem and end the tussle over Kashmir issue.

Naxalite/Maoist movement: This is armed rebellion in some underdeveloped parts of India. It is matter of fact that those parts are lagging behind in development and availability of resources. But armed rebellion is not the answer. The movement has killed over 10,000 people in last 5 years[5]. These deaths include civilians, alongwith security personnel. Naxal leaders, causing this genocide, claim it to be for the underdeveloped tribals and villagers. But in the process tribals to do not show allegiance to this movement are brutally killed. The international links of this movement should be checked for supplies of ammunition and finance. They claim to be followers of Maoist ideology.

Linguistic Minorities: There are mainly 22 languages recognized by the Constitution of India e.g. Bengali, Gujrati, Marathi etc. But there are more than 800 dialects. Many dialects have their own literature. Linguistic minorities never face the problem of discrimination or coercion from main languages in any form. They cherish their own parlance of communication. All these Indic languages are products and derivatives of Sanskrit.

Dalits – Scheduled Castes and Scheduled Tribes: Casteism prevalent in Hindu religion have caused the genesis of downtrodden minorities called as Dalits. In ancient days, person’s occupation ensued his/her caste. And child used to learn father’s occupation and continue with it as grown up. This resulted into a situation where taking birth intro certain community was decisive of that person’s caste.

People doing menial work considered to be of lower caste. The same occupation continued for generations and it resulted into inverse position. A person taking birth into certain caste had to take up the occupation of his forefathers’. Untouchability was like adding insult to injury. This caused downtrodden class of certain catses considered as lowest on the social strata.

Efforts for emancipation of Dalits: Dr. Babasaheb Ambedkar was himself a Dalit born in 1891 in a family having lowest social status at that time. He faced embarrassing situations. But he did his education with confidence and went to London School of Economics where he completed his D.Sc. Then he was awarded with a Ph.D. by Columbia University in America. When he returned to India he dreamt of social justice for his brethren and struggled for it. He is considered as the Architect of the Constitution of India, for he was the Chairperson of the Drafting Committee for the Constitution. Therefore we find ample provisions in the Constitution for giving social justice to the oppressed and discriminated castes.

Dalit community is also progressing. Presently the Chief Minister of India’s biggest state is a Dalit woman. We had Dalit Vice Chancellors for Mumbai University as well as Pune University[6]. Dalit industrialists and businesspersons have come together and formed ‘Dalit Chamber of Commerce’[7]. The community is awakened to their social, political and economic rights and is progressing day by day.

Today, apart from Constitutional, legal and statutory provisions, the real solution would be to mingle with people from Dalit community and convince them about the importance of education and assimilate them into the mainstream by giving them respect and honour.

The Hindu civilization and its oldest scriptures give us some principles, which are essential for world peace. I end up here with mentioning some of them.

1. Idea of global village: This thought is known as वसुधैव कुटुंबकम् (vasudhaiv kutumbakam) meaning, “whole world is one family”. Today due to technological advancements, we have come so closer that one cannot turn blind eye to other country’s problems, as they ultimately affect every country to some extent. Be it EURO concern or terrorism, we shall stand united to face these challegens.

2. One Truth, various ways: एकं सत् विप्राः बहुधा वदन्ति | (ekam sat, viprah bahudha vadanti) meaning our ultimate aim is one, but the ways to reach this goal are different. Therefore, God is one, and everybody tries to reach him by various ways of worship, we call it as religions. Thus for religious tolerance and freedom to profess religion, this maxim is essential. Some scriptures give example as raindrops fallen at different places come through different rivers and brooks but ultimately merge into sea. That should be the idea behind unifying mankind having different religions.

3. Love towards ecology and nature: Hindu philosophy believes that God is all pervading. In Swami Vivekananda’s words, “Each soul is potentially divine. The goal is to manifest this divinity within by controlling nature, external and internal. Do this either by work, or worship or psychic control, or philosophy, by one, or more or all of these -and be free. This is the whole of religion. Doctrines, or dogmas; rituals, or books, or temples, or forms, are but secondary details."

Ultimately I pray for happiness to all of us: सर्वे भवन्तु सुखिनः, सर्वे सन्तु निरामयाः, सर्वे भद्राणि पश्यन्तु, मा कश्चिद् दुःखमाप्नुयात् | ॐ शान्तिः शान्तिः शान्तिः| (May everyone be happy, may everyone be free from all diseases, may everyone see goodness and auspiciousness in everything, may none be unhappy or distressed. Aum peace, peace, peace!)

अपघात, मदत आणि कायदा...

अपघात नेहमीच अचानक आणि न ठरवता होतात. ठरवून घडवला तर घातपात होतो. आणि अपघात मनुष्याच्या निष्काळजीपणामुळे अथवा यंत्रांच्या बिघाडामुळे होतात. परंतु अपघात घडल्यानंतर तो कोणाच्या निष्काळजीपणामुळे झाला, कोण चूक, कोण बरोबर हे ठरविण्यापेक्षाही त्या अपघातात सापडलेल्या अभागी जीवाला मदत पोहोचवणे हे अधिक गरजेचे असते.

साधा रस्त्यावरचा अपघात घेतला तरी त्यात लोक जखमीच्या मदतीला जायला, त्याला रुग्णालयात न्यायला घाबरतात. ते बरेचदा कचरतात याचं कारण म्हणजे पुढील चौकशीचा ससेमिरा. म्हणून प्रत्यक्ष मदत करणारे फार कमी आणि बघ्यांची मात्र हीss गर्दी असेच दृश्य आढळते. रुग्णालयात नेल्यानंतरसुद्धा तिथे उपचार सुरु होण्याआधी औपचारिक चौकश्या, कागदपत्र बनविणे, बरोबर कोणी आहे का, नातेवाईक कोण आहेत, पोलिसांना कळवले का, त्यांचा कागद आणला का अशा सर्व यक्षप्रश्नांना मदतीसाठी सरसावलेल्या व्यक्तींना सामोरे जावे लागते. आणि या कटकटीमुळेच मनात इच्छा असूनही लोक मदतीला जात नाहीत. या सर्वाचा परिणाम मात्र त्या रुग्णाला सहन करावा लागतो. कधीकधी तर रुग्णाचे प्राणोत्क्रमणही होण्याची शक्यता असते.

हे सर्व कायदा, कायद्याची भीती, कोर्टकचेरी यामुळे होत असल्याचे न्यायपालिकेच्या लक्षात आले. ही परिस्थिती अशीच राहणे कोणाच्याच हिताचे नाही आणि ती बदलायला हवी हे लक्षात घेऊन न्यायपालिकेने १९८९ साली एक महत्वपूर्ण निकाल दिला, जो अजूनही प्रसिद्धीअभावी जनसामान्यांपर्यंत पोहोचलेला नाही. प्रस्तुत निकालाची पार्श्वभूमी व त्यातील काही अंश येथे उधृत करत आहे.

पंडित परमानंद कटारा यांनी १९८८ साली एक रीट याचिका सर्वोच्च न्यायालयात दाखल केली. (Criminal Writ Petition no. 270 of 1988). सर्वोच्च न्यायालयाने दि. २८.८.१९८९ रोजी परमानंद कटारा विरुद्ध भारत संघराज्य (Pt. Parmanand Katara v/s Union of India) या निकालाद्वारे आपले विचार प्रकट केले आहेत. न्या. रंगनाथ मिश्रा आणि न्या. जी. एल. ओझा यांनी प्रस्तुत निकालपत्र दिले आहे. स्कूटरवरून जाणाऱ्या एका व्यक्तीला चारचाकी गाडीने उडवले आणि ती गाडी पुढे निघून गेली. एका सहृदय माणसाला रक्ताच्या थारोळ्यात पडलेल्या त्या स्कूटरचालकाला मदत करावीशी वाटली आणि तो त्याला घेऊन जवळच्या रुग्णालयात गेला; परंतु तिथे त्याला दुसऱ्या एका रुग्णालयाचे नाव सुचविण्यात आले आणि सांगण्यात आले की, ‘रुग्णाला घेऊन तिथेच जावे लागेल, कारण त्या रुग्णालयात न्याय-वैद्यक बाबी पहिल्या जातात.’(medico-legal cases). ते दुसरे रुग्णालय तिथून २० किमी अंतरावर होते. मदत करणाऱ्या व्यक्तिने लगेच तिथपर्यंत पोहोचण्याचा प्रयत्न केला; परंतु दुर्दैवाने वाटेतच त्या अपघातग्रस्त स्कूटरचालकाचे जखमांमुळे निधन झाले. प्रस्तुत घटनेची बातमी तत्कालीन ‘हिंदुस्तान टाईम्स’ मध्ये छापून आली. त्याचे शीर्षकच होते ‘Law helps the injured to die’. आणि या बातमीच्या आधारेच पंडित परमानंद कटारा यांनी याचिका दाखल केली.

न्यायालयाने या घटनेची गंभीर नोंद घेत भविष्यात असे प्रकार टाळण्यासाठी आपल्या निकालात निरीक्षणे नोंदवून निर्देश दिले. या निकालपत्राचे महत्व यामुळेच वाढते की, त्यात सर्वोच्च न्यायालयाने अशा घटनांमध्ये वैद्यकीय सेवा पुरविणाऱ्या संस्था/व्यक्ती यांची भूमिका काय असावी हे स्पष्ट केले आहे.

Per Ranganath Mishra J. “It should be the duty of a doctor in each and every casualty department of the hospital to attend such person first and thereafter take care of the formalities under the Criminal Procedure Code. The life of a person is far more important than the legal formalities. In view of this, the deponent feels that it is in the interest of general human life and welfare that the Government should immediately make such provisions in law and amendments in the existing laws, if required, so that immediate medical relief and care to injured persons and/or serious patients are available without any delay and without waiting for legal formalities to be completed in the presence of the police officers. The doctor attending such patients should be indemnified under law from any action by the Government/police authorities/any person for not waiting for legal formalities before giving relief as a doctor would be doing his professional duty; for which he has taken oath as medical practitioner.”

Per G. L. Oza J. Some apprehensions were expressed because of some misunderstanding about the law of procedure and the police regulations and the priorities in such situations. On the basis of the affidavit filed by the Union of India and considering the matter it is clear that there is no legal impediment for a medical professional when he is called upon or requested to attend to an injured person needing his medical assistance immediately. There is also no doubt that the effort to save the person should be the top priority not only of the medical professional but even of the police or any other citizen who happens to be connected with the matter or who happens to notice such an incident or a situation. But on behalf of the medical profession there is one more apprehension which sometimes prevents a medical professional in spite of his desire to help the person, as he apprehends that he will be witness and may have to face the police interrogation which sometimes may need going to the police station repeatedly and waiting and also to be a witness in a court of law where also he apprehends that he may have to go on number of days and may have to wait for a long time and may have to face sometimes long unnecessary cross-examination which sometimes may even be humiliating for a man in the medical profession and in our opinion it is this apprehension which prevents a medical professional who is not entrusted with the duty of handling medico-legal cases to do the needful, he always tries to avoid and even if approached directs the person concerned to go to a State hospital and particularly to the person who is in charge of the medico-legal cases. We there- fore have no hesitation in assuring the persons in the medical profession that these apprehensions, even if have some foundation, should not prevent them from discharging their duty as a medical professional to save a human life and to do all that is necessary but at the same time. We hope and trust that with this expectation from the members of the medical profession, the policy, the members of the legal profession, our law courts and everyone concerned will also keep in mind that a man in the medical profession should not be unnecessarily harassed for purposes of inter- rogation or for any other formality and should not be dragged during investigations at the police station and it should be avoided as far as possible. We also hope and trust that our law courts will not summon a medical professional to give evidence unless the evidence is necessary and even if he is summoned, attempt should be made to see that the men in this profession are not made to wait and waste time unnecessarily and it is known that our law courts always have respect for the men in the medical profession and they are called to give evidence when necessary and attempts are made so that they may not have to wait for long. We have no hesitation in saying that it is expected of the members of the legal profession which is the other honourable profession to honour the persons in the medical profession and see that they are not called to give evidence so long as it is not necessary. It is also expected that where the facts are so clear it is expected that necessary harassment of the members of the medical profession either by way of requests for adjournments or by cross examination should be avoided so that the apprehension that the men in the medical profession have which prevents them from discharging their duty to a suffering person who needs their assistance utmost, is removed and a citizen needing the assistance of a man in the medical profession receives it.

We would also like to mention that whenever on such occasions a man of the medical profession is approached and if he finds that whatever assistance he could give is not sufficient really to save the life of the person but some better assistance is necessary-it is also the duty of the man in the medical profession so approached to render all the help which he could and also see that the person reaches the proper expert as early as possible.

तेव्हा या निकालाची पुरेशी प्रसिद्धी करण्याचे निर्देशही निकालपत्रातच दिले आहेत; परंतु आजही डॉक्टर्स, परिचारिका, वैद्यकीय सेवा पुरविणाऱ्या संस्था, विशेषतः अपघात विभाग, सामान्य जनता, समाजसेवी संस्था, रुग्णमित्र, पोलीस, वकील अशांना याची माहिती नाही. या जनजागृतीतून कित्येक जीव वाचू शकतात. म्हणूनच ही भूमिका अधिकाधिक जणांपर्यंत पोहोचेल हे पण पाहिले पाहिजे.

Minority appeasement: wickedness of secularism in Maharashtra.

Secularism: ‘basic structure’ – Constitution of Bharat ensures ‘secularism’ to all citizens of Bharat. Infact Preamble to the Constitution was amended in 1976 by Constitution (Forty-second Amendment) Act to incorporate the word ‘secular’. And now it is considered as a part of ‘basic structure’ under the concept of ‘basic structure’. So much is the importance of ‘secularism’ to us.

There are many aspects one should take into consideration while dwelling upon the idea of secularism. Where this concept/word originated? And why? Did Bharat had much better concept and principles to serve the intended purpose? Are religion and Dharma one and the same? What is the difference? I will not go into that debate as it will deviate from the issue in concern. But for the sake of understanding we can take the meaning of secularism as ‘equal to all religions’. And this will be acceptable to all of us except few extremists, for whom we shouldn’t care!

Therefore duty cast upon the State is to endeavor for preserving ‘secularism’ not only through its advertisements but also through its schemes, programmes and policies. But stooping to low levels of minority appeasement for vote politics is not new for us. It should be opposed tooth and nail. Syllabuses may contain lessons of ‘Ram and Rahim were friends in a village’ etc. but if your policies aim at division of population on religious lines hardly those lessons will help.

A good case challenging the constitutionality of religion based scholarships has lost in Bombay High Court recently. Now they have filed Special Leave Petition in the Supreme Court against the High Court order. It is learnt that SC has issued notices to Central and State Govts. Lets see what happens next.

Minority Welfare – The State Government of Maharashtra has separate Ministry for Minority Development. Under this Ministry the Govt. spends money on certain religious communities. This money is tax-payers’ money coming from majority community in major proportion. This needs allocation on development issues which are beneficial to all irrespective of religion, caste, creed, race, language etc. But under the guise of ‘minority development’, State Govt is wasting money on non-developmental issues. They may consider it as ‘investment’ which will reap them some votes. But it surely is detrimental to secularism and faith of people, especially majority Hindu community, in the State.

Allocating State Fund – State already has a Haj House in Mumbai which assists Muslims to go on Haj pilgrimage. ‘Haj subsidy’ issue is famous. SC also held its validity. Poor Muslims may be assisted to visit Mecca. And that is continued. Now recently CM Prithviraj Chavan inaugurated a new Haj House at Ganjipeth, Nagpur. This Haj House has come up on 19,000 sq.ft. It was completed by spending ` 15.5 crore. It has 40 rooms with 10-person each capacity. State Govt worked very hard and efficiently in this regard and accomplished the promise!

We are not sad about it, and we are not happy either. Had we been so rich and contented we could have supported it. That is not the case unfortunately. State Government of Maharashtra is very poor according to its own statements on various occasions. But that’s only when developmental and other issues are on table. Tell them that ‘minority’ community is involved in it, instantly they will swing into action releasing more funds than demand persists. Infact at the inauguration of this newly built Haj House, CM Prithviraj Chavan has demanded ` 500 crore from Centre towards various developmental activities for minority communities in 10 districts of state. Let us look at some examples where Govt has said it has no money or shown apathy to take up the work giving reasons of financial crunch.

1) 1) No fund for ‘sainik schools’ – Sainik School in Satara is facing problems. The school principal Lt-Col Matthew Meriken says he has spent most of his tenure chasing bureaucrats to speed up the release of funds for the school. Maharashtra state school education secretary J M Phatak, while admitting that there were no funds for Sainik Schools in the state budget, says that ‘‘certain funds’’ have been approved for release, but held up because of a financial crunch. http://www.indianexpress.com/oldStory/5948/

2) State has no funds to buy power for Thane, Pune – Electricity consumers in Thane, Navi Mumbai, Pune, Mulund and Bhandup have been going through two to three hours of loadshedding for the past three days. This, despite the fact that they pay an additional 43 paise per unit to state power company Maharashtra State Electricity Distribution Company Ltd (MSEDCL). The extra amount is for the energy that the MSEDCL draws from outside the state. According to a source, these areas need 350 MW of electricity more on a daily basis in order to bring their loadshedding hours to nil. Though the MSEDCL has the permission to spend only Rs 9.30 per unit to buy energy from outside Maharashtra, the rates are not less than Rs 13 per unit. Such is the condition of State Government. Why then it spends money on non-developmental issues? Think.. Can this Government serve your purpose? Is it really secular? Where is going the money you pay in form of tax? Do they deserve the posts we have given them? Is it not mockery of our faith in the State Government? Can poor and undernourished be divided on the lines of religion? Hindu children in melghaat and Chadrapur, Bhandara deserve no empathy, aid and help from State? And that too only because they are Hindus? Urban poor having Hindu faith cannot get religion based scholarship, which his ‘minority’ neighbour can very well avail of, only because he was born as a ‘Hindu’?

mouthful on whose labor? Generosity upon whose property?

It is important and rather imperative for us to bring our attention to one news featured this week, for it's not only directly related to our social security and national integrity, but because it has a huge potential to pose us a serious secuirty threat if its not taken into consideration with due diligence, and if it gets ignored like many other incidents that we have had in the past, though they directly concern us. Federal Beurau of Investigation (FBI) (America's Interal Intelligence Agency) authorities recently arrested Ghulam Fareed, a 62 year old Pakistan national - a spy on charges of trying to use ISI funds to influence American policy on Kashmir. So what, what's the big deal Right?! Well, we will get to that, let's first go through this man's career profile.

Federal Bureau of Investigation (an Internal Intelligence Agency + counter-intelligence Agency for United States of America) recently arrested Gulam Fai -a 62 year old Pakistani National / a spy. To understand how this is relevant to our national security, lets discuss his "career" profile first!

Background information: Mr. Fai was born in Vaadvan village from Badgam district of Jammu and Kashmir. He graduated from Shri Pratap college of Shrinagar. But interesting part is ahead. He chose Aligarh Muslim University for his post-graduation. He went to Mecca (Saudi Arabia) thereafter -thanks to some scholarships, and then for Ph.D. in US. He was a member of organization called "Jamaat-e-Islami", in fact since when he was in India. His childhood friend was none other than Hijabul Mujahideen's terrorist leader Moh'd yusuf shah alias Sayyad Salahuddin.

Fai's profile: Mr. Fai runs two organizations- one in US called "Kashmir American Council" and the second in England called "Justice Foundation". He has his so-called "Kashmir Centers" at three locations, namely Washington, London and Brussels. He has shrewdly been running these operations for the last 25-30 years. He has been instilling the media and the people with Pakistan's point of view on Kashmir through politicians, political analysts, column writers etc. amounting to political lobbies supporting notion of Independent Kashmir, which in essence is an attempt to snatch away Kashmir completely from India. In addition to the meet ups, he has been using all the possible ways that are there in effective negotiation or management strategy books e.g. tempting/luring "intellects" for monetary and social benefits for the opinions that they would express. This is important! Role of an intellect behind a political lobby or any revolution cannot be understated. This man organizes grand conferences, conventions often inviting these pre-programmed parrots.. err.. intellects that would focus on the topics that effectively will make an attempt to weaken India's case, reinforcing Pakistani point of view!

Financial perspective: As you would imagine, a covert operation like this requires enormous amount of money. Pakistan has spent about 4 million dollars since 1990 (equivalent to about 2,00,00,000 `) to support his establishments. If this was not enough, Mr. Fai gets personally benefited with funding that ranges annually from 500000 to 700000 dollars. Rashtriya Swayamsevak Sangh today runs schools across Purvanchal and tribal areas all across the nation and it receives the necessary financial aid from abroad partially. In an attempt to cut short organization of such aids, anti-national groups have infiltrated internet with their websites defaming RSS activities. However, there is not a word heard when it comes to Mr. Fai, his activities and his funding. One would easily infer the underlying connections, I have nothing more to say!

Our thickheaded intellect "friends": Its been said that a wise enemy is always better than stupid friend! And we are never short of such stupid friends around us. Its hard and unfair to call them as "stupid" considering their intellect otherwise, and its even harder and more unfair to call them as "friends" considering what they continually engage themselves in. Unfortunately though, our nation never faces dearth of such people. Some of these have long been associated with Mr. Fai. And now that the cat is out of the bag, they claim themselves to be totally clueless/ignorant about inconvenient truths. One cannot refute the possibility completely that these very same people may have fallen prey to Mr. Fai's lucrative baits and growing anti-national. In such a case, these are selfish, purely money minded traitors, but there is hardly any hope that the current meek, spiritless government will take any stern action. Anyway, let's see who are these people under scrutiny?

(1) Mr. Kuldip Nayar: He was appointed High Commissioner to Great Britain in 1990, now retired. An ardent supporter for Pakistan-India friendly ties/relations. (2) Mr. Rajinder Sachar: Retired Chief Justice of Delhi High Court. This name should ring the bell, if you care to keep yourself updated with social, political and religious events going around. Congress had shouldered him a responsibility of writing a comprehensive report on social stature of Muslims in India. This "genius" came up with a documentation famously called "Sachar report" which claimed the Muslims of India to be extremely backward and disadvantaged, extremely unjustly oppressed group of people, and suggested the necessity of assistance in each and every aspect in the social structure. Whenever there is any case charged against Hindu majority, the petitioners usually take refuge of the this report. By the way, I forgot to mention Fai runs an organization called "Organization of the Islamic Conference", interesting to see how loyal Mr. Sachar been to Mr. Fai.

(3) Dilip Padgaonkar: A marathi guy! Former Editor of Times of India and head of the three-member interlocutor panel for Jammu & Kashmir. Crucial responsibility of deciding country's standpoint over the issue of Kasmir! But looks like, he too got entrapped. He toured across the valley, but failed to establish the national viewpoint boldly and firmly, and now we know why! He had attended a conference that Fai organized in 2005, and what's more... expenses were incurred by Fai. Government has not yet even discharged him of his responsibilities. He too has the same weak defence, namely ignorance! One of other members in the 3-member panel Mr. Ansari has demanded his resignation. He says, if he now knows who he was dealing with all these years, and how that person has been, what his true motives were, he should now resign.

(4) Mary: Okay, Mary is not her real name. Her identity has been kept confidential in the affidavit at this moment. But based on the following description, its not hard to figure out who she is. One with curly hair, born in India, internationally acclaimed, famous for her anti-India political views on Kashmir, and yet Government of India not taking any action against her. Mr. Fai would not have missed that obviously. He saw that her views were of his great advantage and he could use her for his purposes of lobbying. He emailed Tauqeer Mehmood Butt in March telling him about the UN working group meeting in which Mary was to participate, and that he would meet her on March 17th, between 3pm and 5pm as a side event at the 13th session of the UN human rights council. He later reported him about his "successful" meeting by email. Any guesses who this Mary is?

In a similar fashion, in 2008, ISI sent Fai a list of 6 people (Indians) and asked him to invite them. Accordingly, Fai did organize an event where all those listed were invited.

In August 2008, Fai's handlers had asked him to step up efforts to push the case on Kashmir as one of "self-determination" that was being denied to its residents by India. In September, 2008, Fai duly reported that he "had met with the US assistant secretary of state for south Asian affairs, and that Fai had provided copies of statements by Indian intellectuals and human rights organizations regarding Kashmir." Needless to state, how misrepresented and mistreated India's point of view was in all these documents.

Currently, Fai is on bail, Virginia court accepted his bail plea on $100,000 bond, but ruled that he must remain under house arrest and electronic surveillance during the trial. Both his and his wife's passport would remain under court custody. Close to 50+ supporters waiting outside the court celebrated the acceptance of the bail plea. Let's see what happens now. However, because what he does is primarily detrimental to India and no way relevant to US directly, he may still continue to go on with his activities.

Such Fais are dangerous obviously, but worse are the other people listed above. Wild animals hunting around your house are a danger without any doubt, but remember, more fatal are the poisonous pet snakes you volunteer to give shelter to.

गुलामाचे गुलाम!

भारताच्या सुरक्षिततेला धक्का पोहोचवणारी अजून एक मोठी गोष्ट गेल्या काही दिवसात घडली आहे. अजून एक गोष्ट म्हणण्याचे कारण एवढेच की, प्रत्यहीच अशा गोष्टी घडत आहेत. पण ही गोष्ट दूरगामी परिणाम होणारी आहे. आणि यातून धडा न घेतल्यास महागात पडणारीही आहे.

अमेरिकेच्या एफ.बी.आय. या गुप्तचर संस्थेने गुलाम नबी फई या ६२ वर्षीय पाकिस्तानी हेराला अटक केली आहे. आता या फईचे आणि भारताच्या सुरक्षिततेचे काय सबंध आहेत? यासाठी आधी फईचे ‘कर्तृत्व’ पहावे लागेल.

फईची पार्श्वभूमी – फई चा जन्म जम्मू काश्मीर मधल्या बडगाम जिल्ह्यातील वाडवन गावचा. त्याचे पदवी शिक्षण त्याने श्रीनगर च्या श्री प्रताप कॉलेजातून पूर्ण केले. खरी मजा पुढे आहे. पदव्युत्तर अभ्यासासाठी त्याने ‘अलिगढ मुस्लीम विश्वविद्यालय’ निवडले. तिथून तो शिष्यवृत्ती मिळवून मक्का, सौदी अरेबिया इथे गेला. तिथून पीएचडी साठी अमेरिकेत. भारतात असतानाच तो ‘जमात-ए-इस्लामी’ या संघटनेचा सदस्य होता. त्याचा बालपणीचा मित्र म्हणजे ‘हिजबुल मुजाहिद्दीन’ चा अतिरेकी नेता मोहम्मद युसुफ शाह उर्फ सय्यद सलाहुद्दीन.

फईचे कार्य - तो अमेरिकेत “काश्मीर अमेरिकन कौन्सिल” (KAC) आणि इंग्लंडमध्ये “जस्टिस फौंडेशन” अशा दोन संस्था चालवतो. वॉशिंग्टन, लंडन आणि ब्रुसेल्स या तीन ठिकाणी त्याची “काश्मीर सेंटर्स” आहेत. अत्यंत चलाखीने जवळपास २५-३० वर्षे फई हे काम करतो आहे. काश्मीर बद्दल पाकिस्तानची भूमिका नेत्यांच्या, राजकीय विश्लेषकांच्या, विचारवंतांच्या, स्तंभलेखकांच्या गळी येनकेनप्रकारेण उतरवणे आणि आंतरराष्ट्रीय स्तरावर भारताविरुद्ध पाकिस्तानची बाजू मजबूत करणे, स्वतंत्र काश्मीरसाठी वैचारिक दबावगट निर्माण करणे, एकूण जम्मू-काश्मीर भारतापासून तोडण्यासाठी एक जबरदस्त पार्श्वभूमी तयार करण्याचे काम तो गेली ३ दशकं करतो आहे. यासाठी विविध मार्ग अवलंबले आहेत त्याने. भेटीगाठी तर झाल्याच, पण वेळप्रसंगी पैशाचे आमिष दाखवून आपले मत बदलायला भाग पाडणे, मोठेपणा देऊन आपली बाजू पटवून देणे हे आणि असेच कूटनीतीतील अन्य मार्गही चांगलेच वापरले आहेत.

तो विचारवंतांचे संमेलन घडवून आणतो. त्यात बोलणाऱ्या वक्त्यांना आधी पूर्वपीठिका तयार करून देतो. जेणेकरून वक्ता भारताची बाजू अन्याय्यकारक रंगवून पाकिस्तानी बाजू सबळ करेल. मग या पंचतारांकित संमेलनाचे वृत्त छापून आणायचे. अशी त्याची कार्यपद्धती.

आर्थिक बाजू – यात प्रचंड प्रमाणात पैसा लागत असतो. ९० च्या दशकापासून पाकिस्तान ने फईच्या संस्थांसाठी ४ मिलियन डॉलर्स म्हणजे २० कोटी रुपये खर्च केले आहेत. शिवाय फईला स्वतःला सुमारे ५,००,००० ते ७,००,००० डॉलर्स दरवर्षी मिळतात खर्च करण्यासाठी. राष्ट्रीय स्वयंसेवक संघ आज वनवासी भागात आणि पूर्वांचलात दुर्गम भागात शाळा चालवतो. यात प्रचंड पैसा आणि मनुष्यबळ लागत असते. यातील काही मदत विदेशातून येते. ती मदत येऊ नये म्हणून आपल्या देशातील काही राष्ट्रविघातक शक्तींनी वेबसाईट्स काढल्या आहेत. आणि त्याचा ते जोरदार प्रचार अमेरिका, इंग्लंड इथे करत असतात. पण फई आणि त्याचे ‘फंडिंग’ याबद्दल अजून कोणी चकार शब्द काढलेला नाही. तेव्हा या अशा वेबसाईट्स आणि त्यात असणारे लोक यांचे लागेबांधेच स्पष्ट होतात. सूज्ञास अधिक सांगणे न लगे!

आमचे मूर्ख/विद्वान मित्र/शत्रू – ‘मूर्ख मित्रापेक्षा शहाणा शत्रू परवडला’ असं म्हणतात. आपल्या देशात मूर्ख मित्रांची कमी नाही. पण त्यांची इतरवेळची विद्वत्ता पाहता त्यांना मूर्ख म्हणवत नाही..आणि त्यांचे कार्यकलाप पाहता त्यांना मित्रही म्हणवत नाही. असे हे विद्वान बिलंदर शत्रू आपल्या देशात आहेत. ते फई च्या जाळ्यात सापडलेले आहेत. आणि आता फई चा खरा चेहरा समोर आल्यावर ‘आम्हाला हे काहीच माहित नव्हतं हो’...असा गळा काढायला त्यांनी सुरुवात केली आहे. फईकडून पैसे घेऊन त्यांनी आपली मते बनवल्याचे नाकारता येत नाही. पैशासाठी राष्ट्राची बाजू कमकुवत केल्याचे आणि राष्ट्रद्रोह केल्याचेच हे उदाहरण आहे. परंतु ह्यांच्यावर आपले नेभळट सरकार काही कारवाई करेल असे वाटत नाही. फईच्या इशाऱ्यावर नाचणारे कोण आहेत हे कलाकार?

१. कुलदीप नायर – हे भारताचे उच्चायुक्त होते इंग्लंडमध्ये. आता निवृत्त. भारत-पाकिस्तान मैत्रीचे अगदी हिरीरीने प्रतिपादन करणारे. ह्यांनी फई च्या कित्येक कार्यक्रमांना हजेरी लावली आहे. त्यांचे बचावात्मक म्हणणे असे की त्यांनी वेळोवेळी भारतीय वकिलातीला कळवले होते.

२. न्या. राजिंदर सच्चर – हे एक निवृत्त न्यायमूर्ती. ह्यांचे नाव तुमच्या चांगलेच स्मरणात असेल जर तुम्ही सामाजिक, राजकीय, धार्मिक घडामोडींवर लक्ष ठेऊन असाल. ह्यांना काँग्रेसने भारतातील मुसलमान समाजाच्या परिस्थितीचा अभ्यास करून त्यावर एक अहवाल तयार करायला सांगितला होता. ह्या महाशयांनी असा अहवाल सदर केला की जणू काही मुस्लीम समाज अत्यंत मागासलेला आहे, त्यांच्यावर खूप अन्याय सर्वच क्षेत्रात चालू आहे आणि त्यांना सर्वप्रकारच्या सहाय्याची गरज आहे इ. हा अहवाल ‘सच्चर अहवाल’ याच नावाने प्रसिद्ध आहे. न्यायालयात ज्यावेळी बहुसंख्यक हिंदू समाजावरील अन्यायाच्या केसेस असतात त्यावेळी हमखास विरुद्ध बाजू या अहवालाचा उपयोग करून घेतात. तर अशा ह्या सच्चर चे फई शी सबंध! फई अजून एक संस्था चालवतो ज्याचे नाव आहे ‘ऑर्गनायझेशन ऑफ द इस्लामिक कॉन्फरन्स’. उगाच नसेल त्यांनी तो अहवाल असा केला. फई च्या मीठाला जागले म्हणायचे!

३. दिलीप पाडगावकर – मराठी माणूस! टाईम्स ऑफ इंडियाचे माजी संपादक. केंद्र सरकारने काश्मीरबाबत जो ३ माणसांचा अभ्यासगट नेमला आहे त्याचे प्रमुख. जागतिक स्तरावर भारताची काश्मीरबाबत काय भूमिका असेल हे ठरवणारा एक प्रमुख विचारगट आणि त्याचे हे प्रमुख. हेही अडकले फई च्या जाळ्यात. जम्मू-काश्मीर फिरून वगैरे आले पण ज्या खमकेपणाने आणि कठोरतेने भारताची बाजू मांडायला हवी होती ते केले गेले नाही. त्याचे कारण आता समजते आहे. २००५ साली ह्यांनी फई ने आयोजित केलेल्या एका कार्यक्रमात सहभाग घेतला होता. त्याचा सर्व खर्च फई ने केला होता. अजूनही ह्यांची उचलबांगडी सरकारने केलेली नाही. त्यांचाही लुळा बचाव हाच आहे की मला माहित नव्हते फई असा आहे म्हणून. ३ जणांच्या अभ्यसगटाचे दुसरे सदस्य श्री. अन्सारी ह्यांनी पाडगावकरांच्या राजीनाम्याची अपेक्षा केली आहे. त्यांचे म्हणणे आता समजले आहे की व असा होता आणि आपण त्याच्या पाटाला पाट लावून बसलो होतो, तर आता तरी राजीनामा द्यायला हवा.

४. मेरी – ह्या व्यक्तीचे मेरी हे नाव खरे नव्हे. तिची ओळख गुप्त ठेवण्यात आली आहे. पण एकूण वर्णनावरून तुम्हीही ओळखू शकाल ही मेरी कोण आहे ते! ह्या मेरीवर फई ने लक्ष ठेवले होते. भारतात जन्मलेली, आंतरराष्ट्रीय पुरस्कार मिळालेली, काश्मीरवर भारतविरोधी बोलणारी आणि भारत सरकार तिला काहीच न करणारे. तिच्या पिंजारलेल्या केसांपैकी एकालाही धक्का लागलेला नाही. अशा तिचे भारतविरोधी विचार हे पाकिस्तानला मदतगार ठरू शकतात हे चाणाक्ष फई ने हेरले नसते तरच नवल. मार्चमध्ये फई ने तौकीर मेहमूद बट्ट ला ईमेल केला की, “संयुक्त राष्ट्रसंघाची (UN) एक बैठक आहे. आणि त्यात ही मेरी असणार आहे. संयुक्त राष्ट्रसंघाच्या मानवाधिकार परिषदेची (Human Rights Counsil) १७ मार्चला १३ वी सभा होणार असून, त्यात ३ ते ५ या वेळात तिला बाहेर भेटून घेतो.”

तशाप्रकारे तिला भेटून यशस्वी काम झाल्याचा ईमेल फई ने बट्ट ला पाठवला. तेव्हा ही मेरी कोण असेल?

अशाच प्रकारे आय.एस.आय ने फई ला २००८ मध्ये ६ माणसांची (भारतीयांची) यादी पाठवली आणि त्यांना आमंत्रित करायला सांगितले. त्याप्रमाणे फई ने त्या सर्वांना बोलावून एक कार्यक्रम आयोजित केला होता!

ऑगस्ट २००८ मध्ये फई ला काश्मीरमधील लोकांच्या ‘स्वायत्त मताधिकारावर’ जोर द्यायला सांगितले होते. जो अधिकार भारत त्यांना देत नाहीये. त्यावर फई भेटला अमेरिकेच्या दक्षिण आशियाई संबंधांसाठी सह सचिव असणाऱ्या व्यक्तीला-(Assistant Secretary of state for south Asian affairs) आणि त्याला त्याने भारतीय बुद्धीजीवी लोकांनी, मानवाधिकार संस्थांनी आणि तथाकथित लोकांनी काश्मीर बाबत प्रकट केलेल्या विचारांचे पद्धतशीर आणि संगतवार संकलनच दिले! ज्यात भारताची बाजू चुकीची, अन्याय्यकारक दाखवण्यात आली होती, हे वेगळे सांगयला नको.

सध्या फई ला व्हर्जिनिया न्यायालयाने १,००,००० डॉलर्स च्या जामिनावर सोडले आहे आणि त्याला सध्या नजरबंदीत ठेवण्यात आले आहे. हा जामीन मिळताच न्यायालयाबाहेर जमलेल्या त्याच्या ५० हून अधिक समर्थकांनी जल्लोष व्यक्त केला! त्याच्या बायकोचा पासपोर्ट जमा करण्यात आला आहे. पुढे पाहूया काय होते ते. फई आणि त्याचे काम हे भारताला घातक असल्याने, अमेरिकेशी त्याचा अर्थाअर्थी काही संबंध नसल्याने त्याला पुढे काही होणार नाही असे वाटते.

असे फई घातक तर आहेतच पण त्याहीपेक्षा वरील मंडळी अधिक भयंकर आहेत. घराबाहेर आलेला हिंस्त्र पशू तर भीतीदायक होयच, पण त्याहीपेक्षा तुमच्या-आमच्या चुलीच्या उबेवर वळचणीला वेटोळी घालून बसलेले हे विखारी-विचारी साप अधिक भयद्रावक!

राष्ट्रगीताच्या निमित्ताने...

आपले राष्ट्रगीत हे खरंच राष्ट्रपुरुष-अधिनायक असे डोळ्यासमोर ठेऊन लिहिले आहे की अन्य कोणाला अधिनायक असे संबोधून लिहिले आहे हा प्रवाद आहे. ‘भो पंचम जॉर्ज’ अशा मानसिकतेतून हे ‘जन-गण-मन’ लिहिले गेले असे मी बरेचदा पिकल्या पानांकडून ऐकले आहे. तुम्हीही ऐकले असेल. पण मी लेखनसीमेस्तव आणि विषयांतराच्या भीतीने त्यात जाणार नाही. सर ही पदवी इंग्रजांना परत करणाऱ्या रवींद्रनाथांनी असं करण्याची शक्यता असावी का? असो.

आपण शाळेत गातो, एरवी ऐकतो त्या २ कडव्यांचे हे राष्ट्रगीत अपूर्ण आहे. संपूर्ण राष्ट्रगीत ६ कडव्यांचे आहे. गांधीजींच्या आश्रमात ज्या प्रार्थना/स्तोत्र/कवनं/भजनं/श्लोक होत असत त्याचं एक छोटं पुस्तक ‘आश्रम भजनावली’ या नावाने प्रसिद्ध आहे. लहानपणी त्या पुस्तकात हे ६ कडव्यांचे राष्ट्रगीत पाहून मी अचंबित झालो होतो. आणि पहिल्या कडव्यांच्या चालीवर अन्य म्हणण्याचा प्रयत्नही केला होता. पण अन्यत्र कुठे छापील स्वरुपात अजून तरी हे संपूर्ण राष्ट्रगीत पहावयास मिळाले नाही. सध्या मात्र ते चर्चेत आले आहे आणि लोकांना माहिती होत आहे की अख्खे ‘जन-गण-मन’ मोठे आहे. ‘टाईम्स ऑफ इंडिया’ ने चांगला पुढाकार घेऊन एक व्हिडियो बनवला आहे ज्यात छान इंग्लिश भाषांतरासहित विविध कलाकारांकडून संपूर्ण ‘जन-गण-मन’ गाऊन-वाजवून घेतले आहे. पण त्यात कलाकार चेहरे असे काही करतात की काही त्रासच होतो आहे! असो. प्रयत्न चांगला आणि स्तुत्य आहे नक्कीच.

पंजाब सिंध ? - सध्या एक विषय चालू आहे. आपल्या राष्ट्रगीतात ‘पंजाब सिंध गुजरात मराठा’ असे आहे तिथे खरेच सिंध हवे की सिंधू हवे? काही जणांच्या मते मूळ रचनेत जरी सिंध असले तरी आता ते बदलून सिंधू करायला हवे. यावर चर्चा, लेख झालेच पण आता याचिका दाखल झाली आहे मुंबई उच्च न्यायालयात! आणि त्यावर न्यायमूर्तीनी केंद्राला अशी विचारणा केली आहे की, ‘का न काढावा सिंध हा शब्द? जर तो प्रांत आता नाही आपल्या देशात तर काढून टाकूया’! राष्ट्रगीताशी सबंधित विषय असल्याने आणि दोन्ही मतप्रवाह असल्याने या विषयासंबंधाने थोडे लिहावे वाटले.

‘पंजाब सिंध गुजरात मराठा, द्राविड उत्कल बंग’ ही प्रदेशांची, प्रांतांची नामावली आहे हे स्पष्टच आहे. ‘विंध्य हिमाचल यमुना गंगा’ यात पर्वत-नद्या असे प्राकृतिक वर्णन आहे. प्रश्न असा की आता जर भारतात सिंध प्रांत नाही, परक्या देशात निघून गेला आहे, तर अन्य देशाच्या भूभागाचा उल्लेख करून राष्ट्रगीत गावे का? आणि मग ते बदलून तिथे सिंधू करावे कारण तिचा काही भाग तरी अजून भारतात आहे. दुर्दैव त्या भारताचे ज्यात लोकांना अन्य विषय न दिसता याचिका करायला हा विषय मिळावा. असो.

राष्ट्र संकल्पना - विभाजनपूर्व भारत हा अखंड होता. आताचा भारत हा खंडित भारत आहे. भारतावर एकछत्री अंमल होता अथवा नव्हता यावर इतिहासकारांमध्ये एकवाक्यता नाही. पण भारत हे एक राष्ट्र होते याचे पुरावे आपल्याला साहित्यातून, वेद वाङ्मयातून, विविध श्लोकांतून, प्रार्थनांमधून मिळतात. आजही गणेशोत्सवात जी आरती-मंत्रपुष्पांजली घराघरात म्हटली जाते त्यात ‘पृथिव्यै समुद्रपर्यंताया एकराळिति’ असाच उल्लेख आपण करतो. राष्ट्र ही संकल्पना भौतिक नाही. मानसिक आहे. हे आधुनिक राज्यशास्त्रानेही मान्य केले आहे. देश अस्तित्वात येण्यासाठी ४ गोष्टींची आवश्यकता असते- १.ठराविक भूभाग, २.लोकसंख्या, ३.सरकार/शासन, ४.स्वायत्तता. ह्या ४ गोष्टी असल्या तर तो भूभाग देश होतो. राष्ट्र नव्हे. राष्ट्र तेव्हाच होते जेव्हा लोकांच्या मनात एकराष्ट्रीयत्वाची भावना असते. आणि म्हणूनच ही संकल्पना मानसिक अवस्थेतून जन्म घेणारी आहे. इतिहासात अशी उदाहरणे आढळतात.

आज ज्यूंचे स्वतंत्र इस्त्रायल हा देश अस्तित्वात आहे. पूर्वी इस्त्रायल अस्तित्वात नव्हता. जगभर विखुरलेल्या ज्यूंना असंख्य हालअपेष्टा, अत्याचार सहन करावे लागले. केवळ जर्मनीतच त्यांच्यावर हडेलहप्पी झाली असं नाही. त्यावेळी जगभरातले ज्यू वर्षातून एकदा एकत्र जमत असत. आणि त्यावेळी जे भोजन होत असे त्याला ‘passover meal’ म्हणत असत. ते जेवण झाल्यावर सगळे एकरवाने म्हणत असत “next meal overthere!”. त्यांच्या कित्येक पिढ्या हे म्हणत स्वर्गवासी झाल्या. जगाने त्यांना वेड्यात काढलं – ‘काय हे चिमूटभर लोक जमतात दरवर्षी आणि म्हणतात पुढच्या वर्षी आपल्या स्वतःच्या देशात, राष्ट्रात भेटू’, ‘शक्य आहे का हे?’ ‘आंतराष्ट्रीय परिस्थिती अशी आहे, हे शक्य नाही’ इ. आणि असेच काही. पण तो स्फुल्लिंग चेतत राहिला. आणि एक दिवस स्वप्नवत्‌ वाटणारे इस्त्रायल अस्तित्वात आले. ज्यूंचे स्वतःचे राष्ट्र म्हणून दिमाखात उभे राहिले. त्यांच्या आजच्या राष्ट्रउभारणीत आधीच्या जगभर पसरलेल्या, मनात प्रबळ इच्छा धरून स्वर्गवासी झालेल्या कित्येक पिढ्यांचा सहभाग आहे. असंच काहीसं जर्मनीचं उदाहरण. जर्मनी विभागला गेला. पूर्व जर्मनी आणि पश्चिम जर्मनी असे दोन भाग पाडले गेले. मधे दोघांना दुभागणारी ‘बर्लिन वॉल’ बांधली गेली. पण मनात इच्छा धरून राहिले ते की आज ना उद्या आपण अखंड जर्मनी म्हणून एकत्र करून राहू. आणि त्याप्रमाणे कित्येक वर्षांनी ती भिंत, ते प्रतिक पाडण्यात आले. जर्मनी एक झाला. अखंड भारत – भारताचं अनेकवेळा विभाजन झालं. आपल्या मात्र १४ ऑगस्ट १९४७ चं पाकिस्तान निर्मितीमुळे झालेलं विभाजनच लक्षात येतं पटकन्‌. त्याआधी ब्रह्मदेश, नेपाळ, श्रीलंका, तिबेट कसे कधी तोडले आपल्या स्मरणातच नाही. अखंड भारतासाठी युक्तिवाद करणारे, शक्तीसंचय करणारे नेते या देशात झाले. पण त्यांच्या तर्काला, विचारांना म्हणावी तशी प्रसिद्धी नाही मिळाली. अर्थातच त्यांचा मार्ग कठीण आणि दुर्गम भासणारा आहे. आणि म्हणूनच समाजमान्यतेला कठीण आहे. स्वातंत्र्यवीर सावरकर, गोळवलकर गुरुजी यांनी अखंड भारताची संकल्पना मांडली आणि उचलून धरली. आजही राष्ट्रीय स्वयंसेवक संघ दरवर्षी १४ ऑगस्ट ला ‘अखंड भारत दिन’ साजरा करतो. जागोजागी कार्यक्रम घेऊन याचं स्मरण करतो की या दिवशी अखंड भारत खंडित झाला, पण आम्ही पुन्हा आमच्या बाहुबलावर अखंड भारत अस्तित्वात आणू. त्यासाठी नित्य नियमित शक्तीसंचय आणि सुसंघटित समाजाची निर्मिती करतच राहू, पण ही आठवण-हे स्मरण नेहमी ताजं ठेवू. अशी कामं एका पिढीच्या हयातीत थोडीच होत असतात? त्याला अनेक पिढ्या बलिवेदीवर चढाव्या लागतात, तेव्हाच अशी स्वप्नं साकार होतात.

महाभारतात पितामह भीष्म म्हणतात – देशाच्या सीमा या आईच्या वस्त्रांप्रमाणे असतात, त्याचं रक्षण करणं हे पुत्रांचं आद्यकर्तव्य असतं. देशाच्या सीमांचे आकुंचन आणि प्रसरण हे त्या देशातील लोकांच्या पुरुषार्थाच्या कमी अथवा जास्त प्रमाणावर अवलंबून असतं.

पंजाब – सिंध? – तेव्हा आता पुन्हा मघाचाच प्रश्न. सिंध प्रांत आता आपल्या देशात नाही. तिथून कत्तल करून पाठवलेले हिंदू मृतात्मे मात्र आहेत. निर्वासित म्हणून आलेले हिंदू-सिंधी आहेत. आणि आजही अश्रू ढाळत वाहणारी काही सिंधू आपल्या प्रदेशात आहे. सिंध ऐवजी सिंधू हा साधर्म्य असलेला शब्द सुदैवाने आपल्या देशात-भाषेत आणि भूभागात आहे म्हणून तिथे बदल करून सिंधू म्हणायचे? आणि जर हीच कसोटी लावली तर मग उद्या नवीन भूभाग आपण जिंकला तर त्याचा समावेश करायचा का राष्ट्रगीतात? शिवाय द्राविड, मराठा असे उल्लेख असलेले प्रदेश तरी कुठे आहेत? उत्कल कितीसा जणांना माहिती आहे?

उद्या कोणी पंजाब बळकावला युद्धात तर तो परत मायभूमीत आणायचे सोडून राष्ट्रगीत बदलायचे? त्यातून पंजाब काढून टाकायचा? आणि घालायचे काय मग? अशाने राष्ट्रगीत बदलत जाईल, आणि पुरुषार्थ कमी होत जाईल. मुलांना कळणारच नाही की आपला विशाल देश कसा होता, आपले पूर्वज कसे होते. अशाने विजिगीषु वृत्ती लोप पावत जाईल. आज सिंध काढलात, उद्या अजून काही काढाल. किंबहुना ते सिंध, ती जखम तशीच राहूद्या. पुढील पिढीला समजावून सांगा की, बाबा रे असा सिंध होता आपला, आता नाही, पण पुढे अवश्य मिळवू. लोक म्हणतील वेडे! खुशाल म्हणू द्या. अशी कामे वेड्यांच्याच हातून व्हायची असतात.

सर्वोच्च न्यायालयाचा निर्णय – अशाप्रकारची याचिका या आधीच सर्वोच्च न्यायालयापुढे येऊन गेली आहे. सध्याच्या याचिकाकर्त्याला अथवा त्यांच्या वकिलांना ही गोष्ट माहित आहे की नाही कळायला मार्ग नाही. पण सर्वोच्च न्यायालयाने १३ मे २००५ रोजी संजीव भटनागर विरुद्ध भारत सरकार या प्रकरणात ‘पंजाब-सिंध’ वर विस्तृत चर्चा केली आहे. याचिकाकर्ते संजीव भटनागर यांचे म्हणणेही असेच होते की आता सिंध हा भूभाग आपला राहिला नाही आणि त्यामुळे राष्ट्रगीतात ‘सिंध’ असणे हे आपला शेजारी पाकिस्तानच्या स्वायत्ततेला धक्का पोहोचवणारे आहे. सर्वोच्च न्यायालयाने याचिका तर फेटाळून लावलीच, पण आपली महत्वपूर्ण निरीक्षणे नोंदवत चर्चाही केली आहे. त्यातले काही उतारे येथे उद्धृत करतो. लेखाच्या शेवटी संपूर्ण निकालाची लिंक दिली आहे. अभ्यासूंनी त्याचा अवश्य वापर करावा. सर्वोच्च न्यायालयाचे तत्कालीन सरन्यायाधीश श्री. आर्.सी.लाहोटी आणि पी.के.बालसुब्रमण्यन् यांच्यासमोर ही याचिका चालली. निकालपत्र लाहोटी यांनी दिले आहे. परिच्छेद ११ मधे ते म्हणतात की, “राष्ट्रगीत हे वीरयुक्त भावना प्रकट करते. ते काही राष्ट्राच्या भूभागांची व्याख्या करणारे नियतकालिक नव्हे. राष्ट्रध्वज, राष्ट्रगीत आणि राजमुद्रा या आणि अशा काही मोजक्या गोष्टी आहेत ज्या आपल्या राष्ट्रीय स्वाभिमानाच्या आणि परंपरेच्या परिचायक आहेत. राष्ट्रगीत लिहिले गेले त्यावेळी असलेल्या राज्यांची अथवा प्रादेशिक भूभागांची सूची ते देत नाही. जेव्हा भूभाग, अंतर्गत मांडणी, भौगोलिक प्रदेश आणि प्रांत बदलतात त्यानुसार राष्ट्रगीत बदलले पाहिजे अशी आवश्यकता नाही. नुकतेच उत्तरांचल, छत्तीसगढ, झारखंड यांची निर्मिती झाली. त्यामुळे आता या नवीन नावांचा समावेश करण्यासाठी राष्ट्रगीत मोठे केले, पुन्हा लिहिले, की बदलले पाहिजे? स्वाभाविक उत्तर आहे – नाही. राष्ट्रगीत ही आपण आपल्या हिमालय ते महासागरापर्यंत पसरलेल्या आणि समुद्रांनी वेष्टित असलेल्या मातृभूमीला दिलेली लढाऊ (वीरश्रीयुक्त) मानवंदना आहे. काही प्रतिकात्मक नावांचा समावेश हे आपल्या भारताच्या गौरवशाली परंपरेचे संस्मरण आहे. ‘सिंध’ हा केवळ भौगोलिक भूभाग नव्हे. तो स्थानाचा आणि त्या लोकांचाही निर्देश करतो. सर्व देशभर पसरलेले सिंधी हे सिंध मधे मूळ असल्याने आणि तिथून आल्याने सिंधी म्हणवले जातात. ‘सिंध’ हा शब्द ‘सिंधू’ अथवा ‘इंडस’ या नदीचाही निर्देश करतो. तो अशाही एका संस्कृतीचा निर्देश करतो जी जगातील सर्वात प्राचीन संस्कृतींपैकी आहे आणि आधुनिक भारतसुद्धा ही सिंधू खोऱ्याची संस्कृती आपल्या परंपरेचा अविभाज्य भाग असल्याचा अभिमान बाळगतो. सिंधू नदी भारतीय प्राचीन साहित्यात असंख्य संदर्भात आढळून येते अगदी ऋग्वेदात सुद्धा.”

This extract is taken from Sanjeev Bhatnagar v. Union of India, (2005) 5 SCC 330, at page 335 :

“A National Anthem is a hymn or song expressing patriotic sentiments or feelings. It is not a chronicle which defines the territory of the nation which has adopted the anthem. A few things such as — a National Flag, a National Song, a National Emblem and so on, are symbolic of our national honour and heritage. The National Anthem did not, and does not, enlist the States or regional areas which were part of India at the point of time when it was written. Nor is it necessary that the structure of the National Anthem should go on changing as and when the territories or the internal distribution of geographical regions and provinces undergoes changes. Very recently Uttaranchal, Chhattisgarh and Jharkhand have been carved out by reorganising certain States. Does it mean that the National Anthem should be enlarged, rewritten or modified to include the names of these new States? The obvious answer is — no. The National Anthem is our patriotic salutation to our motherland, nestling between the Himalayas and the oceans and the seas surrounding her. The mention of a few names therein is symbolic of our recollection of the glorious heritage of India. “Sindh” is not just a geographical region. It refers to the place and to its people. Sindhis are spread throughout the country and they derive their such name as having originated and migrated from Sindh. “Sindh” also refers to River “Sindhu” or “Indus”. It also refers to a culture, one of the oldest in the world and even modern India feels proud of its having inherited the Indus Valley Civilisation as an inalienable part of its heritage. River Indus (Sindhu) finds numerous references in the Indian classical literature including Rig Veda.”

पुढे सर्वोच्च न्यायालयाने अशाच प्रकारची निरीक्षणे नोंदवत याचिका तर फेटाळलीच, पण याचिकाकर्त्याला १०,००० रुपयांचा दंडही ठोठावला. कारण त्याने पूर्वीही अशीच एक याचिका दाखल केली होती. न्यायालयाने याला ‘पब्लिक इंटरेस्ट लिटिगेशन’ नव्हे तर ‘पब्लिसिटी इंटरेस्ट लिटिगेशन’ म्हटले आहे.

तर प्रस्तुतच्या विषयाचा अशाप्रकारे २००५ साली निकाल झालेला आहे आणि न्यायालयाने नि:संदिग्ध शब्दात मतं व्यक्त केली आहेत. मातृभूमी, तिचे गुणगान, आपली अस्मिता, देशाचा भूभाग अशी राष्ट्रीय भूमिका स्वीकारली आहे. त्याबद्दल न्यायालयाचे आभारही मानायला हवेत. आता आपले वैय्यक्तिक मत ज्याचे त्याने ठरवायचे. आणि ते इथे प्रतिक्रिया म्हणून नोंदवायलाही काही हरकत नाही.

Communal Violence Bill - a serious concern.

Prevention of Communal and Targeted Violence (Access to Justice and Reparations) Act, 2011

The Central Government is all set to rip apart the secular fabric of our nation. Will it be playing the old game of ‘divide and rule’ to secure its victory in upcoming elections?

Our country has evidenced communal hatred, violence and tensions for long. Cause may differ, but the result is the same – unrest in society and betrayals between communities. Can we say that existing laws are insufficient to control communal disharmony? Or, implementation is lacking? Is a new Act really needed?

Aims and objectives:

What the Act really aims at? Is there any hidden agenda to gain political mileage? Answers to such and other questions must be searched for by a secular (in its truest sense) and nationalistic mind.

Provisions:

The short title of the Act is ‘Prevention of Communal and Targeted Violence (Access to Justice and Reparations) Act, 2011’.

Section 3 is the definitions Section. On plain reading of the Act, nothing seems inadvertent or harmful. The provisions made for Committees or Authorities at 2 levels – National and State may prove beneficial. The Chairperson of such Committees will be the Prime Minister, the Chief Minister respectively. Every State to appoint a person or appropriate number of persons for every district as ‘Human Rights Defender for Justice and Reparations’.

Chapter I is ‘Preliminary’.

Chapter II lists out ‘Offences’.

Chapter III ‘Prevention of Communal and Targeted Violence’.

Chapter IV ‘National Authority for Communal Harmony, Justice and Reparations’.

Chapter V ‘State Authorities for Communal Harmony, Justice and Reparations’.

Chapter VI ‘Investigation, Prosecution and Trial’.

Chapter VII ‘Relief, Reparation and Restitution and Compensation’.

Chapter VIII ‘Penalties’.

Chapter IX ‘Miscellaneous’.

The objectives and scheme of the Act appear to be promising. But is the exercise really called for? As will be seen later the existing laws are more than sufficient to achieve all of the objectives the present Bill aims at, if the relevant provisions are duly implemented by police and dutifully enforced by the Courts of law. In fact some of the provisions of this Bill may be counterproductive and defeat the very objective of the Act.

Dangerous Provisions:

Still the Act has something more to offer than discussed above. And it is dangerous and detrimental to secularism. Prima facie we cannot detect the trick. But careful and cautious reading of the ‘Definition’ section, set out in Section 3 of the said Act, will bring the catch in light. This is cure more hazardous than the disease itself!

Definitions of two words viz. ‘group’ and ‘victim’ should be read carefully. I quote them: Sec. 3(e) “group” means a religious or linguistic minority, in any State in the Union of India, or Scheduled Castes and Scheduled Tribes within the meaning of clauses (24) and (25) of Article 366 of the Constitution of India;

and now see Sec. 3(j) “victim” means any person belonging to a group as defined under this Act, who has suffered physical, mental, psychological or monetary harm or harm to his or her property as a result of the commission of any offence under this Act, and includes his or her relatives, legal guardian and legal heirs, wherever appropriate; .

Thus a ‘victim’ under this law can’t be outside the scope of the ‘group’ defined in Sec. 3(e) above. Hence it is crystal clear that a ‘victim’ cannot be from Hindu community.

Can’t Hindus be terrorized? If tomorrow a mob of non-Hindu people attacks a Hindu person and burns down his home, he won’t be able to get protection and benefits from the said Act. Plainly because he does not belong to the ‘group’. Therefore Hindu will always be in a box for trial considering him as a born culprit. It implies that a person from minority community will never be a culprit!

Linguistic minority:

A danger looms over due to the usage of term ‘linguistic minority’. How the framers are going to define it? The peculiarity of our nation lies in diversity. Every state has its own language. Though all of our languages, dialects emanate from Sanskrit, they cherish their own literature and style distinctly. Therefore in a particular state, languages other than that state’s official language, will be in minority. For instance, in West Bengal, except Bengali, other languages like Gujrati, Telugu etc. will be minority. In Tamilnadu all languages will be in minority but Tamil. Already we have territorial parties fuelling secessionist feelings and arousing regional fervor for their selfish motives. This Act will create havoc, when complaints and cross-complaints will be filed across the states to satisfy revenge. Undesirable situation will prevail at the behest of this Act. A serious threat to national integration hovers.

Other provisions:

Once the ‘real agenda’ is clear, the other provisions seem to be highly unjust. The ‘victim’ will be provided with all assistance from the State. Not only legal aid but also monetary support will be made available. The complainant’s identity will be kept secret, if he wishes so. Attachment of property, movable as well as immovable, in cases of fine is provided. Therefore a Hindu will suffer a great loss, as he will have to defend himself on his own and his property will be attached but still he won’t understand at who’s instance he is being tried. See Section 40. Identity of victim and informant to be protected.- The National Authority

shall take appropriate action to protect the identity of the victim or informant at all times.

And also Read Section 87 (4)- (a) not mentioning the names and addresses of the witnesses in its

orders or judgments or in any records of the case accessible to the public;

(b) issuing directions for non-disclosure of the identity and addresses of the witnesses;

(c) immediately dealing with any complaint of harassment of a victim, informant or witness and on the same day, pass appropriate orders for protection;

Now let us see what is ‘hate propaganda’. This also will be against ‘group’ or a ‘person from that group’. Therefore everybody is free to incite hatred only against Hindus by publishing, communicating, making signs or visible representations. They will not be liable under this Act, because Hindus are not included in the ‘group’!

8. Hate propaganda.– Notwithstanding anything contained in any other law for the time being in force, whoever publishes, communicates or disseminates by words, either spoken or written, or by signs or by visible representation or otherwise acts inciting hatred causing clear and present danger of violence against a group or persons belonging to that group, in general or specifically, or disseminates or broadcasts any information, or publishes or displays any advertisement or notice, that could reasonably be construed to demonstrate an intention to promote or incite hatred or expose or is likely to expose the group or persons belonging to that group to such hatred, is said to be guilty of hate propaganda.

Who is behind it?

The leadership is totally in the hands of Mrs. Sonia Gandhi, who is all set to thwart the hindu community since long. Time and again it is evident. Emminent journalists, writers have written articles over it. e.g. ‘Italian by birth and Catholic by baptism’ by John McLithon. The puppets in the hands of Mrs. Sonia Gandhi are taking ahead her agenda. Two committees are responsible for preparing this Bill. National Advisory Council (working under PMO) and Drafting Committee. NAC contains 19 members. People like Asgar Ali Engineer, Justice Suresh Hosbet, John Dayal, Sayed Shahabuddin are the members among others. One Sister Mary Scaria is also member of the abovesaid NAC. A person who is vowed by Jesus and is out on a mission for propagation and spread of Christianity, is a member of this NAC. The Drafting Committee is also packed with such members who are known for their Hindu hatred. Teesta Setalwad is member of the Drafting Committee. Now should I say anything more about it? Can such communal people with stereotype mindsets design a proper Bill? They are bound to attack the Hindu community under the garb of protection of minority people.

Opposition to this Bill:

Every prudent person should oppose this Bill. We should place our dissatisfaction on record by various available means. We should write letters to newspapers, our MP, PMO etc. Such articles like this one should be forwarded, So that the Government will not attempt to table this Bill in the Parliament.

If at all it gets tabled and passed, then the President will give her assent instantly, without any hesitation. She may delay Afzal Guru’s mercy petition, but will sign this Bill within no time! In such a calamity we should move the Court challenging the Constitutional validity of this Act. Court may strike it down by declaring it unconstitutional on the basis that fundamental principles enshrined in the Constitution are being flouted.

Nationalist organization RSS' Sarsanghchalak underlines the danger and strong opposition to this Bill.

Concluding remarks:

The Bill poses some serious questions due to the deplorable provisions it contains. One cannot imagine that a Government considers particular community as ‘communal’. It keeps a particular community outside the purview of the Act. Labeling certain community as of terrorists’ is nothing but a beginning of creating future terrorists. The Act, if at all passed, will prove an instrument responsible for the ‘making of terrorists’. It seems that the Government sincerely feels that Hindus cannot be terrorized or targeted, but infact they are only responsible for communal tensions, attacks and targeted violence happening. What a mockery of fate of otherwise peaceful, tolerant and cultured community in their own country – the Hindu nation! सावधान! 'लव्ह जिहाद'...

प्रेम ही एक दैवी गोष्ट आहे. ते कधी कुठे कसं निर्माण होईल कोणीच सांगू शकत नाही. प्रेमाला भाषेची, प्रांताची, जातीचीही गरज नसते. या सर्वांसकट अथवा या सर्वांशिवायही प्रेम होऊ शकते. मुक्यांचेही प्रेम एकएकमेकांवर असते आणि अंधसुद्धा आपल्यावर जीवापाड प्रेम करतात. तेव्हा भाषा, प्रांत, जाती, धर्म, आहार-विहार या पलिकडे प्रेम आहे.

पण ‘खरा तो एकचि धर्म, जगाला प्रेम अर्पावे’ असं सांगणाऱ्या भारतामध्ये मात्र एक भयानक परिस्थिती उद्भवली आहे. इथल्या हिंदू समाजाला येनकेनप्रकारेण फोडण्याचे, संघटित होऊ न देण्याचे आणि धर्मांतरित करण्याचे प्रयत्न शतकानुशतके चालत आलेले आहेत. बळाचा, दडपशाहीचा वापर करून आणि त्यासाठी राजसत्तेचा वापर करून केलेले धर्मांतरण आपण इस्लामी/मोगल काळात अनुभवले आहे. जिझिया कर, मूर्तिभंजन, जोहार आणि हिंदू स्त्रियांनी भरलेला जनानखाना. पुढे इंग्रज राजवटीतसुद्धा बळजोरीने केलेले धर्मांतरण इतिहासात नोंदले गेले आहे, भले ते शिकविले जात नसेल किंवा नजरेस न पडण्याची काळजी सरकार घेत असेल तरी. गोव्यात सेंट (?) झेविअरने केलेले मनुष्यतेला लाजवतील असे अत्याचार आणि केरळ च्या किनाऱ्यावर झालेल्या नृशंस हत्या. पूर्वांचलात (मिझोरम, अरुणाचल प्रदेश, नागाभूमी, त्रिपुरा इ.) तिथल्या जनजातींवर आपली प्रार्थनापद्धत लादायची आणि तुम्हाला मुक्तिसाठी अन्य मार्ग नाही असे सांगायचे. हा धर्मांतरणाचा प्रश्न खूप मोठा आणि विविध पैलू असलेला आहे. लेखनसीमेस्तव इथे सध्याच्या एका ज्वलंत परंतु आपल्याला अपरिचित अशा प्रश्नाचा उहापोह केला आहे. हा ‘विचारप्रवाह’ अधिकाधिक जणांपर्यंत पोहोचवाल या विश्वासाने लिहितो आहे.

केरळ हे तसे शांत, सुशिक्षित, निसर्गरम्य राज्य. पण तिथे एक विषवल्ली फोफावू पाहतेय हे कोणाच्या ध्यानातही येणार नाही. संपूर्ण भारतभर एक सुप्त आणि घातक चळवळ सुरु केली गेली आहे. तिचं नाव आहे “लव्ह जिहाद” अथवा “रोमियो जिहाद”. आणि तिचे अनेक यशस्वी(!) प्रयोग केरळच्या भूमीत झालेत आणि देशभरात त्याचे अनुकरण सुरु आहे.

काय आहे ही चळवळ?

केरळमधल्या महाविद्यालयीन तरुणींना (केवळ मुस्लिमेतर) परिचित करून घ्यायचे, मैत्री वाढवायची, आपल्या जाळ्यात ओढायचे, त्यांच्या धर्मावर टीका करत राहायची आणि इस्लामचे उदात्तीकरण करायचे, त्यांना त्यांच्या कुटुंबापासून फूस लावून तोडायचे, आणि मग त्यांना धर्मगुरू कडे नेऊन धर्मांतरित करायचे, स्वखुषीने लग्न केल्याचे भासवायचे (कागदावर सह्या घेऊन), एकदा शरीरसबंध झाला की सोडून द्यायचे. या कामाचे रीतसर पैसे, दुचाकी आणि अन्य भेटवस्तू घ्यायच्या आणि पुढील मुस्लिमेतर मुली शोधायला कॉलेज कॅम्पस वर चकरा मारायच्या. अशाप्रकारे हळूहळू मुस्लिम जनसंख्या वाढवत न्यायची. ही चळवळ “लव्ह जिहाद” अथवा “रोमियो जिहाद” या नावाने पोलीस, गुप्तहेर खाते आणि याकामाशी परिचित असलेले सामाजिक कार्यकर्ते, संशोधक, यातील न्यायालयीन कामकाजाशी सबंधित न्यायमूर्ती व वकील आणि काही पत्रकार यात सुपरिचित आहे. परंतु आम जनतेला अजून याचा सुगावा लागलेला नाही. ‘जिहाद’ च परंतु एक नवीन रूप घेऊन पुढे आला आहे.

शेहान शा आणि सिराजुद्दीन विरुद्ध केरळ राज्य

ह्या दाव्यामुळे बरेचसे चित्र स्पष्ट होण्यास मदत झाली आहे. यातील आरोपी शेहान शा आणि सिराजुद्दीन यांची वये अनुक्रमे २३ वर्षे आणि २७ वर्षे आहेत. ह्या दाव्यातील एका निकालात न्यायमूर्ती श्री. के. टी. शंकरन् ह्यांनी विशेष आस्था दाखवत प्रश्नाच्या मुळाशी जाण्याचा प्रयत्न केला आहे. केवळ प्रस्तुतचा दावा निकालात काढून स्वस्थ बसण्याकडे त्यांचा कल दिसून येत नाही. मूळ समस्येची खोली जाणून घेऊन त्यांनी प्रस्तुतचे निकालपत्र दिले आहे. हे निकालपत्र मी खाली जोडले आहे. त्यात सर्व कथानक/घटनाक्रम त्यांनी व्यवस्थित दिला आहे.

प्रस्तुतच्या दाव्याचे कथानक असे – २ मुली, ज्यांची ओळख गुप्त राहावी म्हणून न्यायालयाने त्यांचा उल्लेख ‘हिंदू मुलगी’ आणि ‘ख्रिश्चन मुलगी’ असाच केला आहे, एम्.बी.ए. शिकत असलेल्या, आपसात मैत्रिणी असलेल्या. शेहान हा त्यांचा सिनिअर, पण कॉलेजने काही कारणाने काढून टाकलेला. त्याने मैत्री प्रस्थापित केली हिंदू मुलीशी. लगेचच तो हिंदू धर्माविषयी वाईट बोलू लागला, टीका करू लागला. घरी गेल्यावर शेहान ची आईसुद्धा हिंदू धर्मावर टीका करत असे. शेहान ने आता इस्लाम मधे धर्मांतर करण्यासाठी दबाव टाकायला सुरुवात केली, आणि असे न केल्यास आपली मैत्री संपेल असे सांगितले. दुसऱ्या मैत्रिणीला (ख्रिश्चन मुलगी) असंच सांगून दोन्ही मुलींना आपले घर सोडण्यासाठी फूस लावण्यात आली. एका पहाटे ३ वाजता ठरल्याप्रमाणे दोन्ही मुली आपापल्या घराबाहेर आल्या आणि त्यांना एका स्कॉर्पिओत घालून एर्नाकुलम् ला नेण्यात आले. आत आधीपासून बसलेल्या अन्य दोन महिलांप्रमाणेच या मुलींनाही बुरखा घालण्याची सक्ती करण्यात आली. गाडीत केरळमधल्या ‘पॉप्युलर फ्रंट’ या राजकीय संघटनेच्या सीडीज लावण्यात आल्या होत्या. एर्नाकुलम् ला एका जागेत त्यांना नेण्यात आल्यावर तिथून घरच्यांशी संपर्क साधून देण्यात आला आणि ‘आम्ही पोन्नानी नावाच्या ठिकाणी इस्लाम स्वीकारण्यास जात आहोत’ असे सांगण्यास लावण्यात आले. दुसऱ्या दिवसी खदीजा नामक एका महिलेने दोन्ही मुलींना लॅन्सर गाडीत घालून मलप्पुरम ला हनीफा हाजी च्या घरी नेले. १० मिनिटातच त्यांना कोंडोट्टी मधे दुसऱ्याच एका घरात नेले. तेथे २ आठवडे राहिल्यावर पुन्हा हनीफा हाजीच्या घरी २ आठवडे ठेवण्यात आले. हा सर्व काळ ‘पॉप्युलर फ्रंट’ चे सदस्य सतत भेट देत होते.

‘ख्रिश्चन मुली’चे कोणाशीच प्रेमसंबंध नव्हते. तिला अनेकांना ‘दाखवण्यात’ आले. मग लग्नाबद्दल विचारण्यात आले. पण दोन्ही मुलींना हा सुगावा लागला की त्यांना लग्न करून बंगलोर ला नेण्यात येणार आहे आणि तिथे दुसऱ्याच कोणाला देऊन टाकण्यात येणार आहे. शेवटी शेहान ने आपला मित्र सिराजुद्दीन (प्रस्तुत दाव्यातील आरोपी क्र. २), जो कर्नाटक राज्य परिवहन सेवेत कंडक्टर आहे, याला बोलावून घेतले. मध्यंतरीच्या काळात मुलींच्या घरच्यांनी ‘हेबिअस कॉर्पस्’ चा रिट पिटीशन दाखल केला. शेहान आणि सिराजुद्दीन दोन्ही मुलींना घेऊन कालिकत ला वकिलाकडे गेले व तिथे लग्न करायला तयार असल्याच्या करारावर सह्या करायला लावण्यात आल्या. तिथून पुन्हा हनीफा हाजीच्या घरी. रात्री शेहान व हिंदू मुलगी एकत्र राहिले आणि सिराजुद्दीन व ख्रिश्चन मुलगी एकत्र राहिले. सिराजुद्दीन ने ख्रिश्चन मुलीला अनैसर्गिक संभोगास भाग पाडले, ज्याबद्दल त्याच्यावर भा.दं.वि. ३७७ कलम लावण्यात आले आहे.

कोर्टासमोर हजर झाल्यावर मुली पालकांसोबत जायला तयार नव्हत्या. पण कोर्टाने समजावल्यावर त्या तयार झाल्या. पुढील तारखेला त्या मुली आरोपींसोबत जायला तयार नव्हत्या.

त्या मुलींना अश्लील सीडीज देण्यात आल्या होत्या आणि त्याबरोबरच इस्लाम ची महती सांगणारी आणि इस्लाम स्वीकारण्याला प्रवृत्त करणारी पुस्तके देण्यात आली होती. शिवाय पोलीस यंत्रणेकडे काहीही झाले तरी ‘पॉप्युलर फ्रंट’ चे सदस्य या धर्मांतराच्या कामात मदत करत असल्याचे उघड न करण्याबाबत आणि त्यांचे नाव न घेण्याबाबत वारंवार बजावण्यात आले होते.

न्यायालयाचा दृष्टिकोन

न्यायालयाने या दाव्याचे निकालपत्र देताना आपली मते नोंदवली आहेत. न्यायालयाने यात निःसंशय ‘धर्म’ आणि ‘धर्मांतर’ या गोष्टी मुळाशी असल्याचे नोंदवले आहे. शिवाय केवळ या दाव्यापुरते मर्यादित न राहता अशा अन्य घटना, त्यातून बाहेर येणारे एक सर्वव्यापी ‘डिझाईन’, एक चळवळ यावर प्रकाश टाकला आहे. यात येणारा आंतरराष्ट्रीय सबंध, पैसा, धार्मिक नेते, संस्था याबद्दल अधिक चौकशी करण्याचा न्यायालयाचा मानस दिसून येतो. या दाव्यात न्यायालयाने केरळ राज्याचे ‘डायरेक्टर जनरल ऑफ पोलीस’ (डीजीपी) यांना ८ प्रश्न विचारले आणि त्यावर सविस्तर अहवाल दाखल करायला सांगितले.

न्यायालयाने डीजीपी यांना विचारलेले ८ प्रश्न

१. ‘लव्ह जिहाद’ अथवा ‘रोमियो जिहाद’ अशी काही चळवळ केरळ राज्यात कार्यरत आहे का?

२. जर हो असेल तर त्यांची योजना आणि डाव काय आहे?

३. या प्रकारच्या कामात कोणत्या संस्था/संघटना सहभागी आहेत?

४. ह्या प्रकारच्या कार्यकलापांना पैसा कोठून येतो?

५. गेल्या ३ वर्षांत अशाप्रकारे किती शालेय/महाविद्यालयीन विद्यार्थी, तरुण इस्लाममध्ये धर्मांतरित झाले आहेत?

६. या तथाकथित प्रकल्पाची व्याप्ती आणि योजना अखिल भारतीय स्तरावर आहे काय?

७. ह्या कामी विदेशातून आर्थिक मदत येते आहे का?

८. ‘लव्ह जिहाद’ चळवळ आणि बनावट चलन, तस्करी, अंमली पदार्थ व्यवहार आणि आतंकवाद यांच्यात काही सबंध आहे काय?

डीजीपी, केरळ राज्य यांनी वरील प्रश्नांना दिलेली उत्तरे

१. ‘लव्ह जिहाद’ अथवा ‘रोमियो जिहाद’ नामे कोणतीही संस्था अथवा चळवळ केरळ राज्यात कार्यरत असलेली आढळून आली नाही.

२. वर म्हटल्याप्रमाणे अशा संस्था/संघटनांच्या कार्याबाबत सबळ पुरावा नाही.

३. अशा प्रकारच्या जबरदस्तीच्या धर्मांतरात गुंतलेल्या विशिष्ट संस्था/संघटना आढळून आल्या नाहीत.

४. याबाबत विश्वासार्ह पुरावा अद्याप उपलब्ध नाही.

५. आत्ता दाखल असलेळी २ प्रकरणे वगळता अशी जबरदस्तीच्या प्रेमाधारित धर्मांतराची अन्य तक्रार प्रकरणे नाहीत. प्रस्तुत २ प्रकरणात पोलिसांनी तक्रार दाखल करून घेतली असून तपास चालू आहे.

६. ह्याबद्दल सबळ पुरावा नाही.

७. आंतरराष्ट्रीय आर्थिक पाठबळाबाबत सबळ पुरावा नाही.

८. याबद्दल सबळ माहिती नाही.

पुढे डीजीपी आपल्या अहवालात म्हणतात – मुलींना जाळ्यात ओढून जबरदस्तीने अथवा फसवणुकीने धर्मांतर करण्याचे आरोप काही संस्था/संघटनांवर झाले आहेत. पोलीस अधिक शोध घेत आहेत. त्यात तथ्य आढळल्यास कडक कारवाई करण्यात येईल. आंतरधर्मीय विवाह खूप मोठ्या संख्येने केरळात होत आहेत. आणि त्यात अनेक धर्मांतरण प्रकार होत असतात. पोलीस यंत्रणेकडे याचा ठोस आकडा अथवा तपशील उपलब्ध नाही. परंतु तरीही मुस्लिम तरुणाशी प्रेमात पडल्यानंतर मुलीला तिचा धर्म बदलायला प्रवृत्त करण्यात येत असल्याचे निश्चित प्रयत्न होत असल्याचा संशय घेण्यास पुरेशी कारणे आहेत. विभागाला मिळालेल्या अनिश्चित सूत्रांकडच्या माहितीनुसार अशा प्रकारच्या तंत्राने धर्मांतरण करायला प्रोत्साहन देणारे काही गट तरुणांमध्ये कार्यरत आहेत. या कमी गुंतलेल्या तरुणांना कपडे, वाहने आणि कायदेशीर मदत यासाठी प्रत्यक्ष वा अप्रत्यक्षपणे विदेशातून आर्थिक मदत येते आहे. आणि अशांचे भारतातील अन्य ठिकाणीही संपर्क-संबंध आहेत.

या प्रकारची प्रस्तुत प्रकरणे, आरोप आणि सूत्रांकडची माहिती या आधारे पोलीस सतर्क आहेत आणि अधिकाधिक माहिती गोळा करत आहेत. अशा प्रकरणात पोलिसांकडे तक्रार दाखल करायला शक्यतो कोणी पुढे येत नाही ही मुख्य अडचण आहे. तरीही पोलीस स्वतः सतर्क राहून अशा प्रकारच्या जबरदस्तीच्या धर्मांतरणावर त्वरित कारवाई करतील.

केरळ पोलीस च्या गुप्तहेर खात्याला सुद्धा अशा जबरदस्तीच्या धर्मांतरणात गुंतलेल्या संस्था/संघटना यांवर करडी नजर ठेवायला सांगण्यात आले आहे.

न्यायालयाचा शेरा व अधिक महितीसाठीचा प्रयत्न

डीजीपी यांचा अहवाल प्राप्त झाल्यावर न्यायालयाने त्यातील माहिती ही अस्पष्ट असल्याचे आणि आपसात मेळ न राखणारी असल्याचे मत व्यक्त करीत पुढील माहिती सीलबंद लखोट्यात मागवली - जिल्हा पोलीस अधिकाऱ्यांकडून (एस्. पी.) प्राप्त झालेले जिल्हाशः अहवाल, अन्य कनिष्ठ अधिकाऱ्यांकडचे अहवाल, अन्य माहिती ज्यावर आधारून अहवाल बनवण्यात आला. ही माहिती सादर करताना डीजीपी यांनी काही अधिकाऱ्यांकडून काही जिल्ह्यात असे कार्य चालल्याचे मान्य करून १८ अहवाल सादर केले.

न्यायालयाने १८ अहवालांचा अभ्यास करून नोंदवलेले मत

१८ पैकी १४ अहवाल हे अतिशय त्रोटक आहेत. एक अहवाल तर म्हणतो – मी माहिती आणि पुढील कार्यवाही याबाबतीत शून्य अहवाल पाठवतो आहे. (“I am herewith forwarding a NIL report favour of information and further necessary action".). अन्य १३ अहवाल १ ल्या प्रश्नाचे उत्तर सर्वसाधारणपणे “जिल्ह्यात आढळले नाही”, “जिल्ह्यात दिसून येत नाही”, “जिल्ह्यात अशी कोणती संघटना नाही” असे देतात आणि अन्य प्रश्नांची उत्तरे तर NA (Not Applicable) अशी देतात. कोणत्या आधारावर हे निष्कर्ष काढले याचीही काही माहिती त्यात दिलेली नाही. १ अहवाल मुसलमानांनी आणि हिंदूंनी कोझिकोडे शहरात चालवलेल्या धर्मांतरणाच्या केंद्राबाबत नमूद करतो.

१८ पैकी ३ अहवाल काही तपशील पुरवतात.

एक अहवाल ‘स्मार्ट फ्रंट’ या संघटनेच्या २ महाविद्यालयातील कार्याबाबत सांगतो.

दुसरा अहवाल विशेष शाखेने केलेल्या तपासातून निष्पन्न झालेला निष्कर्ष देतो – त्यात नमूद केलेल्या शहरात “ कॉलेजेस मध्ये NDF, PFI आणि कॅम्पस फ्रंट या मूलतत्त्ववादी संघटनांची मुळे आहेत. कॅम्पस फ्रंट बद्दल अहवालात नमूद केले आहे की, “उपलब्ध माहितीनुसार या संघटनेचा प्लान असा – संपन्न कुटुंबातील, हुशार, उच्चवर्णीय हिंदू मुली आणि ख्रिश्चन मुली यांना जाळ्यात ओढायचे, विशेषतः प्रोफेशनल कोर्सेस व आय.टी.सेक्टर मधे नोकरी करणाऱ्या.”

या तथाकथित ‘लव्ह जिहाद’ चळवळीमागे ‘मुस्लिम यूथ फोरम’ यासारख्या मुस्लिम संघटना आणि मुस्लिम महिला संघटना ‘थसरीन मिल्लत’, ‘शाहीन फोर्स’, ‘पॉप्युलर फ्रंट ऑफ इंडिया’ आणि ‘नॅशनल डेमोक्रेटिक फ्रंट’ आणि तिची विद्यार्थी संघटना ‘कॅम्पस फ्रंट’ अशा संघटना ‘लव्ह जिहाद’ चळवळीमागे आहेत.

आर्थिक पाठबळ दर्शविणारा सबळ पुरावा नाही; पण हे माहिती आहे की त्यांना पाठिंबा आणि आर्थिक पाठबळ हे ‘नॅशनल डेमोक्रेटिक फ्रंट’ आणि ‘पॉप्युलर फ्रंट ऑफ इंडिया’ कडून मिळते. काही अन्य मुस्लीम मूलतत्त्ववादी संघटना आखातातील देशांमधून पैशाची व्यवस्था करत आहेत. या माहितीची सत्यता पडताळून पहायला हवी.

वर उल्लेखलेल्या संघटनांच्या कार्यकर्त्यांकडून मदत घेऊन तिरुअनंतपुरम्‌ जिल्ह्यात धर्मपरावर्तनाची १०० हून अधिक उदाहरणे घडली आहेत असे वरील अहवाल सांगतो. अशा ३१ मुलामुलींची पत्त्यासकट माहिती अहवालात दिली आहे. हा अहवाल पुढे म्हणतो – संपूर्ण भारतात लव्ह जिहाद संघटनांची कारवाई चालू असल्याचा पुरावा अजून नसला तरी ही चळवळ मुस्लीम संघटनांच्या मदतीने १९९६ साली सुरु झाल्याचे बोलले जाते.

सौदी अरेबियातील काही संघटना अशा प्रकारच्या कृत्यांसाठी तरुणांना आर्थिक पाठबळ “शिष्यवृत्ती” या नावाखाली पुरवत आहे.

एका सांख्यिकीनुसार गेल्या ४ वर्षांत प्रेमप्रकरणानंतर ३००० ते ४००० धर्मबदलाची उदाहरणे आहेत. अन्य एका सांख्यिकीनुसार अशाप्रकारे २८०० मुली अन्य धर्मात धर्मांतरित झाल्या आहेत. कासारगोड, कन्नूर, कोझिकोडे आणि मलप्पुरम् जिल्ह्यात अशाप्रकारचे १६०० धर्मांतरण प्रकार घडले आहेत. अशाचप्रकारे हिंदू मुलींना इस्लाममध्ये धर्मांतरित करण्याच्या कारवाया उत्तर प्रदेश, महाराष्ट्रातील पुणे, कर्नाटकात बंगलोर या ठिकाणी चालू असल्याचे अहवाल सांगतो. अहवाल असे स्पष्ट निरीक्षण नोंदवतो की ‘गुप्तचर खात्याच्या’ (Intelligence Wing) मते अशा प्रकारच्या प्रेमविवाहांमुळे समाजात तेढ आणि संघर्ष वाढण्याची चिन्हे आहेत.

केंद्र सरकारला (केंद्रीय गृहखात्याला) आपली भूमिका स्पष्ट करण्याचे आदेश देण्यात आले. बराच वेळ काढल्यानंतर (मुदतवाढ मागून घेत घेत) त्यांनी स्पष्ट केले की घटनेच्या २५ व्या कलमानुसार ‘सेक्युलॅरिझम’ हे मूलभूत तत्व आहे वगैरे. आणि त्यानंतर राज्य सरकार वर जबाबदारी ढकलून ते मोकळे होतात. ते म्हणतात “ राज्य सरकार या बाबतीत जबरदस्तीने, आमिषाने, फसवणुकीने होणारे धर्मांतर रोखण्यासाठी कायदा बनवू शकतं. अरुणाचल प्रदेश, गुजरात, हिमाचल प्रदेश, मध्य प्रदेश आणि ओरिसा राज्यांनी अशाप्रकारे धर्मांतरण रोखण्यासाठी कायदा पास केला आहे. परंतु केंद्र सरकार या बाबतीत केंद्रीय कायदा करण्याच्या दिशेने कोणतेही पाउल उचलण्याच्या विचारात नाही. ” असे का? हे आपण स्वतःलाच विचारले पाहिजे. प्रत्येक राज्याने असा कायदा करावा असे एकीकडे म्हणायचे आणि स्वतः मात्र या विषयावर पाउल उचलायला कचरायचे असे का होते आहे? या हिंदूद्वेषामागे नक्की कोण आहेत?

पुढे प्रस्तुत निकालपत्रात मा. न्यायाधीश दुसऱ्या एका याचिकेचा उल्लेख करतात जी प्रस्तुत दाव्यातील आरोपींच्या वकिलाने मधल्या वेळात दाखल केली आहे. त्यात तो वकील म्हणतो की, ‘न्यायाधीशांनी मुस्लीम युवक, हिंदू मुलगी, ख्रिश्चन मुलगी असे उल्लेख करायला नको याने सांप्रदायिक तेढ वाढेल’. हे म्हणजे ‘सौ चूहे खाके बिल्ली चली हाज’ सारखे झाले! शिवाय या याचिकेत जमीन अर्ज मागे घेत असल्याचे सांगून कुराणातील कवन उद्धरित करून शेवट केलाय. ते म्हणतात, “आम्ही जमीन अर्ज मागे घेत आहोत. आम्हाला आमच्या दैवाच्या भरवशावर सोडावे आणि कायद्याला स्वतःचा मार्ग घेऊ द्या. कारण आरोपी जाणतात - “जर अल्लाने तुम्हाला त्रास द्यायचा ठरवला तर केवळ अल्लाच त्यातून वाचवू शकतो: आणि जर त्याने तुम्हाला चांगल्या नशिबाचा आशिर्वाद दिला तर कोणीच ते थांबवू शकत नाही. जाणून घ्या, की सर्व बाबींवर ‘त्या’चे नियंत्रण आहे.”(कुराण. सुरा-६, आयत १७). परंतु मा. न्यायाधीश ठामपणे आपले मत योग्यच आहे हे सांगून ‘विसरा आणि क्षमा करा’ (forget and forgive) यावर आपला अधिक विश्वास असल्याचे म्हणतात. ते कणखरपणे अर्ज मागे घेण्याच्या डावाला नकार देतात. ‘असोसिएशन फॉर ह्युमन राईट्स’ नामे एका संस्थेने ‘लव्ह जिहाद’ हे शब्द वापरू नयेत म्हणून केलेल्या अर्जालाही ते प्रस्तुत दाव्याशी संबंध नसल्याचे सांगून नकार देतात व अन्यत्र प्रयत्न करण्यास सांगतात.

निकालपत्राच्या शेवटच्या काही परिच्छेदात मा. न्यायाधीश संविधानाच्या दृष्टिकोनातून (२५ वे कलम) धर्म, धर्मासंबंधीचे स्वातंत्र्य, प्रेम विवाह, जबरदस्तीने होणारे, आमिष दाखवून होणारे धर्मांतरण, शासनाची जबाबदारी ए.बद्दल विस्तृत चर्चा करतात. ते म्हणतात, “डीजीपींना दिलेल्या अहवालात पोलीस अधिकारी अशाप्रकारे ठराविक धर्माच्या मुलींना अन्य धर्मात धर्मांतरित करण्याचे योजनाबद्ध प्रयत्न सुरु असल्याचे मान्य करतात. हेही स्पष्ट होते की असे प्रयत्न अहवालात नमूद केलेल्या काही संघटना करत आहेत. याची दाखल लोकांनी आणि विशेषतः सरकारने घ्यायला हवी. लोकांचे मूलभूत आणि नागरी हक्क संरक्षित करण्यासाठी सरकार कटिबद्ध आहे. भारतीय संविधानाचे २५ वे कलम कोणालाही जबरदस्तीचे धर्मांतरण करण्याच्या कारवाईत गुंतण्याची मुभा देत नाही. एकाला दिलेले स्वातंत्र्य त्याने दुसऱ्याचे हिरावून घेण्यासाठी वापरता काम नये.”

“पालकांना आपल्या मुलांना हवे तसे वाढवण्याचा अधिकार सुद्धा नजरेआड करता येणार नाही. केवळ मुलगा अथवा मुलगी वयात आली याचा अर्थ त्याच्या/तिच्या पालकांना त्यांच्या भविष्याबाबत आणि करिअरबाबत काही बोलता येणार नाही असा होत नाही. पालक आपल्या मुलांचे संरक्षण करण्यास कटिबद्ध आहेत. पालकांना आपल्या मुलांना मार्गदर्शन करण्याचा आणि त्यांचे करियर घडवण्याचा अधिकार आहे. कलम २५ खालील अधिकार कोण अनोळख्या, अनाहूत व्यक्तिला एखाद्या मुलीच्या पालकांचे अधिकार हिरावून घेण्याची संमती देत नाहीत. २५ वे कलम व्यक्तिस्वातंत्र्याचे रक्षण करते. त्याचा उद्देश कुटुंबव्यवस्था आणि संस्कृती नष्ट करणे नाही. आपल्या देशातील कायदे हे नागरिकांच्या हक्कांचे रक्षण करणे आणि संस्कृती व परंपरा यांना जपणे यासाठी आहेत.”

“शैक्षणिक संस्था, प्रोफेशनल कॉलेजेस आणि अन्य संस्था अशा ठिकाणी तरुण हे शिकण्याच्या ध्यासामागे आणि ज्ञान मिळवण्याच्यामागे असतात. ही स्थाने धर्मांतराची कुरणे बनता नयेत. घटनाकारांना शैक्षणिक संस्था धर्मांतराची स्थाने झाल्याची कल्पनाही सहन झाली नसती. कोणाला धर्मशास्त्रातील विद्वान व्हायचे असेल तर त्याने अवश्य व्हावे पण इतरांना धोक्यात घालून नव्हे.”

“सदर प्रकरणातील घटना, प्रसंग लक्षात घेता आणि त्यांचा प्रकार व गंभीरता पाहता मी ‘सिव्हिल प्रोसिजर कोड’ च्या धारा ४३८ खाली दिलेला ‘डिस्क्रेशनरी रिलीफ’ देऊ शकत नाही. म्हणून सदर दिलासा मागणारा अर्ज मी फेटाळत आहे.”

कायदेशीर सहाय्य – हा लेख वाचून बऱ्याच जणांना आपल्या आसपासच्या, ओळखीतल्या, नात्यातल्या घटना आठवतील. असे प्रकार घडले, माहित असले तरी त्यावर कोर्टात आपली बाजू घेऊन कोण लढेल असे वाटल्याने बरेचजण पुढे जात नाहीत, परंतु केरळ मधल्या त्या मुलींच्या घरच्यांनी असे धारिष्ट्य दाखवले, त्या मुलीही लढायला तयार झाल्या. अशाप्रकारे मुंबई उच्च न्यायालयातील काही वकिलांनी एकत्र येऊन एक गट स्थापन केला आहे जो अशाप्रकारच्या अन्यसुद्धा हिंदुत्वाला घातक असणाऱ्या विषयांमध्ये कायदेशीर लढाई लढत राहील. तेव्हा अशा घटना मोकळेपणाने तुम्ही या गटाला कळवू शकता. या लेखाखाली प्रतिसाद दिल्यास आपण पुढील माहिती मिळवू शकतो.

Osama bin Laden- just some thoughts.

Though Laden’s death was answer to many questions, it surely has generated more questions for the word community.

First of all, how Laden became so much powerful a man and became most wanted? Certainly in his early days, he had assistance and aid of some ‘great’ nations, who for their own benefit and selfish motives nurtured him. They may give it a sophisticated name of ‘balance of power’, but surely it was more than that. Osama was used in the cold-war.

Osama’s organization carried out some attacks on US and some on the soils of other nations. The devastating attack flabbergasted the US. It killed thousands of innocents from different religions, different countries. Such heinous act had neither reasoning nor justification. And after this 9/11, US avidly searched for the mastermind – The Osama.

Many term it as a crusade or tussle between two religions – Christianity and Islam. I see point in it. Though economic, national and political interests are embedded in this ‘war on terror’, we cannot overlook religious aspect of it; rather religious fanaticism. US had certainly waited patiently to kill Osama. It is very difficult to believe that US could not trace Osama for ten years. On the one hand, a person – who controls such a big organization, supplies own videos, speeches to broadcast worldwide, remains head of the organization without any evident rebellion – and on the other – a mighty nation, powerful military intelligence, satellites’ network which can trace an inch of the Earth, military bases in Af-Pak and what not?

Hence a strong case exists to believe that, US also feared the eruption of religious tussle between Christendom and Islamic camp. Infact Bush administration had miserably increased the rift and conflict. The challenge before Obama Govt was to diminish this feeling of hatred, enmity and hostility. Therefore, his first ever official visit, after assuming office of the President, was to Egypt. He gave solace and confidence to Muslim world, that US is not an enemy of Islam in general.

US carried out the strike at right time. In these ten years i.e. from 2002 to 2011, US passed through a phase of recession. Also it used this period to pacify the Islamic world. It might have staged and directed the revolts and mutinies in countries like Egypt, Tunisia, Syria, Yemen, etc. to keep their rulers engaged in their own affairs of disorderly states. Thereby US ruled out the possibility of these States coming together and opening up a ‘united camp’ that was anti-US. The turmoil and turbulence in the Islamic world ensured that Osama’s death won’t have instant serious repercussions.

Pakistan had no idea of Osama hideout on its soil is unconvincing. A bungalow so near to Pak Military Academy, having barbed wire fencing and standing alone with 8 times higher walls than average height in the surrounding area! Only thing is that, Pakistan could not have envisaged its step-father coming down upon it so heavily and dramatically.

US very cleverly pushed the dead body into the sea. But there is room to believe that US might have pushed something else, resembling Osama’s body and took the real body homewards to examine and investigate more.

Al-Qaida and Taliban have surely received a jerk. But nobody can ensure the world community that terrorist activities will end. Infact, we fear to see more conspiracies, attacks and destruction in coming days.

Should we be talking about ‘human rights’ of Bin Laden? The basic concept of human rights believes that these rights are acquired by a person simply because he is a human being. As soon as he/she is born, acquires human rights. But can there be a thought that, a person who is gross violator of human rights of others and does inhuman acts knowingly for continued prolonged period becomes ineligible to claim its own? Will he lose them? Otherwise, fanatics, extremists, communists-naxalites will claim the protection of shield of human Rights after violating that of others. This is happening in Bharat.

We congratulate US for not making an issue of Laden’s human rights. Such demonic creatures should be thrashed and destroyed to safeguard humanity. Laden received what he deserved.
